MINUTES
PLANNING & ZONING COMMISSION
January 3, 1991
The meeting of the Planning & Zoning Commission was called to order
Tuesday, January 3, 1991 at 7:30 by Chairman John Sargent. Members
present were James Brown, Marilyn George, Don Smith, Edward Ivey,
Bonnie Kranz, and Adelbert Evans: Members absent were .Peter
Bertonaschi and Carlos Solis. Also attending were Wayne Saunders
City Manager and Mimi Hauch Planning Technician.
MINUTES of the meeting held December 4, 1990. were approved as
presented.
NEW BUSINESS:
l., REQUEST FOR CONDITIONAL USE PERMIT
APPLICANT: Janice D. Smith
LOCATION: 469 Broome Streef:
REQUEST: To operate a child care facility in the R-3
Residential/Professional District.
Mr. Saunders stated that the applicant is requesting a CUP to
operate a day care facility at 469 Broome Street. The property is
zoned R-3 Residentialf Professional. but will allow for this use
with a CUP.
:~Ir. Saunders informed the commission that there are two existing
structures on the described site. The western structure is to be
converted to the day care use and the eastern structure will be a
residential unit.
Staff recommended approval of the use, however, the proposed
parking is unacceptable. Staff recommended approval subject to
final site plan approval which will include a minimum of five (5)
paved spaces meeting the City's codes and requirements.
Staff also recommended the fallowing conditions in addition to the
standard Conditional Use Permit conditions:
1. A new certificate of occupancy must be issued.
2. All regulatory agency rules must be met prior to issuance of
the certificate of occupancy.
3. The structure must be inspected by the fire inspector and all
requirements met prior to a certificate of occupancy being
issued.
4. Sidewalk shall be installed along tree right of way.
5. Building located on the eastern parcel to be used as a single
family residence only.
Mr. Saunders stated that the commission might c,~art to conside_ ~~he
possibility of allowing the applicant 18 months to install the
sidewalk. At the end of the 18 months the applicant would teen be
required to put the sidewalk in, or there is the possibility what
new regulations could be in place at that time which would allow
the applicant the option of putting the sidewalk in at ano~.her
location or contributing to a fund.

Mr. Brown asked if due to the age of the structure the installation
of the sidewalk was necessary.
Mr. Saunders stated that it has been a policy when a conditional
use permit is issued to require the installation of sidewalks at
the site if none exist.
Mr. Smith stated that he felt the sidewalk was necessary in this
case due to the building being utilized as a child care facility.
He felt that the sidewalk would be of some value even though it
would not connect with a sidewalk on either side.
Mrs. George stated that she felt that sometimes we should be
flexible. In a situation like this, where there is little or no
pedestriar.~traffic or vehicle traffic, perhaps we should wait until
sidewalks are built to the east or west of this property and at
that time require the applicant to build one.
Mr. Sargent agreed with the addition of "or 18 months which ever
comes first".
A motion was made by Adelbert Evans to recommend approval to the
City Council with the amendment of condition #4 to read "sidewalks
to be installed within 18 months", seconded by James Browri and
approved by a unanimous vote.
There being no further business the meeting was adjourned.
