A meeting of the Planning & Zoning Commission was held in the Council Chambers
on Tuesday, June 5, 1979. The meeting was called to order at 7:30 P.M. by
Chairman Ruth Alice Ray with the following members present: Mrs. L. Cook and
Messrs. Czech, Sargent, Jones, Meginley, Wilcox, and Sullivan. City officials
present were: City Manager Forbes and City Attorney Baird. Others present
were: Mesdames Smith and Hanks, and Messrs. Hanks, Roberts, and McMahon. Mr.
Earl Kirkland, CUP applicant, arrived later in the meeting.
The invocation was given by Chairman Ray.
The Minutes of the meeting held May 1, 1979 were approved as written.
The Public Hearing on the Earl Kirkland Conditional Use Permit was deferred
until later in the evening pending Mr. Kirkland's arrival.
COMMUNITY APPEARANCE STANDARDS GUIDE
A draft Community Appearance Guide was reviewed by the Commission. A
copy of the draft is attached hereto. Mr. Meginley advised that it was
the desire of the Community Appearance Standards Committee to include
sketches in the Guide; to include a "checklist" for easy reference; and,
That the Committee would continue work on the Guide at its next meeting
to be held Monday, June 18th at 7:30 P.M. in the City Manager`s office
at City Hall.
AREAS OF INFLUENCE
City Manager Forbes advised of a meeting of the P&Z and County Planners on
Tuesday, June 19th at 7:30 P.M. in the Council Chambers to discuss areas
of influence for the City and how to achieve better coordination between
the City and County.
PUBLIC HEARING-CLASSIFICATION OF USE/CONDITIONAL USE PERMIT REQUEST
City Manager Forbes advised of a request by Mr. Earl Kirkland for a
Conditional Use Permit to utilize the existing buildings located on Lots
8 and 10, City Block 80, commonly known as 732 Montrose Street, in order
to operate a retail decorator supply store and for the construction of
custom cabinets and furniture in a C-2 zone; That a determination need
be made as to whether the proposed use is a contractors and builders supply
store that belings only in a manufacturing zone, where such uses are
permitted, or whether the proposed use is a retail-type business that
meets the requirements of the C-2 General Business Zone (C-2 zoning
allows similar businesses which are not more obnoxious or detrimental to
the district than the uses already permitted.)
Mr. Earl Kirkland and Mr. Harold Roberts, Realtor, appeared before the
Commission in support of the request advising that all business activities
would be confined to an enclosed building; That the noise level would be
low (he advised that at his present business location in Minneola,
abutting property owners had registered no complaints); That flammable
substances would be stored in a safe, enclosed building; and, That it
was his desire to pursue the establishment of a retail-type business as
opposed to custom cabinet and furniture construction.
Following inquiry if there was anyone present who wished to address the
matter, wherein Mrs. Ruby Hanks expressed her support of the request,
motion was made by Mr. Sargent, seconded by Mr. Meginley, and unanimously
carried that the Commission recommend to the City Council that the request
of Mr. Earl Kirkland be granted subject to the following conditions:
(1) No undesirable odors or loud noise shall be detected ourside the
building. Any such odors or noise that creates a nuisance to abutting
property owners shall constitute prima facie evidence that this condition
has been violated; (2) That the loading/unloading of manufacturing
materials be confined to the rear of the building; (3) That all materials,
manufacturing, retailing, and storage be held within a separate enclosed
building; (4) That all applicable regulations and ordinances be met; (5)
That the use not be expanded except with a Conditional Use Permit; and (6)
That a Certificate of Occupancy be issued only after all conditions are
met.
ZONING REGULATIONS
City Manager Forbes presented a proposal for minor revisions in residential
zoning districts, and a new format for these regulations which will make
zoning regulations simple and precise so that they can be better under-
stood by citizens as well as enforced by City Staff. A copy of the
proposed revisions is attached hereto.
City Manager Forbes advised that the basic revision to present regulations
is that R3A and R3 zoning district regulations be combined inasmuch as
the two zones are essentially the same with one exception - R3 zoning
allows professional office type business but only as a conditional use.
It is his contention that the two zones should be combined into one zone
with conditional uses that allow businesses.
The Commission reviewed the proposed revisions and format and it was their
consensus that more study time was necessary and that the matter be
placed on the agenda for the next regular meeting to be held July 3rd.
The meeting was adjourned by Chairman Ray at 9:00 P.M.
