08-05-1980 Meeting CITY OF CLERMONT PLANNING & ZONING COMMISSION . MINUTES • This meeting of the Planning and Zoning Commission was called to order • by Chairman Ruth Alice Ray at 7:30 p.m, on Tuesday, 1 September 1980 in the City Council Chambers. ROLL CALL. Present: Chairman Ruth Alice Ray, Henry Czech, Laura Cook, Nick Jones and Mike Conley. Absent: Louise Relyea, Jack Sargent and Bob Thompson. Approval of the Minutes of the August 5, 1980 meeting were tabled until the October Planning and Zoning meeting. PUBLIC HEARING ON PROPOSED CITY REZONING Chairman Ruth Alice Ray discussed the City's Comprehensive Planning Process and the history behind the proposed changes. She stated that there were nine areas in which rezonings were proposed, and that comments would be received on each general area. Area Number 1 - Central Business District: PROPOSED REZONING FROM R-3 TO C-2/CBD Legal Description - Block 79, Lots 14, 16, 18, 20. Block 92, 91, 90, 80, 81, 82, 76; Lots 1, 2, 3, 7, 8, 9, 10, 11, 12, 13 of Block 75; Lots 2, 4, 6, 8, 10, 12, 14, 16, 18, 20 of Block 77; Lots 2, 4, 6, 8 of Block 93. It was explained that this is not a change of zoning but a clarification of the present Central Business District, by describing it by legal description in- stead of meets and bounds. There was no public comment on this proposal. Area Number 2: PROPOSED REZONING FROM C-2 to R-3 Legal Description Lots 1, 3, 5, 7, 9, 11, 13, 15, 17, 19 of Block 77. It was explained that the predominant uses on this part of the block are now residential. This change would also use rear lot lines as zoning boundaries to reduce any further zoning conflict homes exist. s across the street where single-family There were no public comments on this proposal. Area Number 3: PROPOSED REZONING FROM C-2 or C-1 TO R-3 Legal Description - That part of Block 110 Lying North of Highway 50; Block 99, 89A and Block 73; Block 60 except Lots 7 and 8; Block 45, Lots 2, 4, 6, 8, 10, 12, 14 and 16. It was discussed that the zoning changes along Highway 50 are designed to eliminate Strip Commercial Zoning throughout the City on Highway 50. Most of the area redesignated to R-3 is primarily residential now or vacant property, despite years of commercial zoning. The proposed R-3 zoning would allow professional offices and high density residential uses. CITY OF CLERMONT PLANNING & ZONING COMMISSION MINUTES Page -2- • Property owners Mr. Collins, Mr. Walker, Mr. Boone, Mr. Cook, Mr. Hanks and Mr. Lyons all spoke in opposition to any changes along Highway 50. They believed that the best use for their property was as a commercial use and that the R-3 zoning was not practical for this property. Many of the owners had petitions to have this property rezoned many years ago, and strongly resented any change. After much discussion, the consensus of the Planning and Zoning Commission was that the part of Block 110 Lying North of Highway 50 and Block 99 should remain zoned C-2. The Planning and Zoning Commission believed the other changes were still desirable. Area Number 4: PROPOSED REZONING FROM C-1 TO C-2 Legal Description - Lots. 7 and 8 of Block 60; Lots 18 and 20 of Block 45; Lots 4, 5, 6, of Block 7; all City Blocks. There was no opposition to the proposed changes in this area. Area Number 5: PROPOSED REZONING FROM C-1 TO C-2 Legal Description - Lots 1, 3, 5, 7, 9, 11, 13, 15, 17, 19 of Block 89, Lots 3, 4, 5, 6, 7, 8, 9, 15, 17, 19 of Block 85; Lots 1 through 10 of Block 72. There was no opposition to the proposed changes in this area. Area Number 6: PROPOSED REZONING FROM C-1 TO R-3 Legal Description - Lots, 2, 4, 6, 8, 10, 12, 14, 16, 18 of Block 89; Lots • 1, 2, 10, 11, 12, 13, 16, 18, 20 of Block 85; Lots 11 through 19 of Block 72; Block 61 except Lots 10, 11, 12 and Block 44 except Lots 17 and 19; Block 28; Block 17; all City Blocks; and Block 8, Ella Vista Heights, Lots 1 through 7 and 16 through 19. It was discussed that these changes were important to change the zoning along rear lot lines on Highway 50 and eliminate undesirable effects to residential homes on Chestnut Street should business develop along this property. Many property owners that own businesses along Highway 50 also own property that goes through to Chestnut Street, and the fact that their businesses should not be cut in half by two different zones was discussed. A letter from the Pelican Oil Company further reflected this point. It was the consensus of the Planning and Zoning Commission to further review this matter. Area Number 7: PROPOSED REZONING FROM R-3 TO R-2 Legal Description - Lots 3, 4, 5, Block 20; Block 19; plus closed street. It was explained that this area has a steep slope and is adjacent to a pre- servable lake and single-family residential area. A letter from the owner, Carl Cerilli in opposition to this request was read in full. Chairman Ray asked that the record reflect that she was in favor of rezoning this prop- erty back to R-1, although she would go along with R-2 zoning. She also asked that the record reflect that no favoritism was being considered for any person in the proposed changes. u CITY OF CLERMONT PLANNING & ZONING COMMISSION MINUTES Page -3- Area Number 8: PROPOSED REZONING FROM C-1 TO R-3 • Legal Description - Lots 14 through 19, Block 2, Homedale; corner of S.E. of Lot 6, Block N. It was explained that this change would eliminate a small, mostly unused commercial district in a residential neighborhood. It was pointed out that Mr. Floyd has a plumbing shop in this area. No one present spoke in opposition to the change. Area Number 9: PROPOSED REZONING FROM C-2 TO R-3 Legal Description - Tracts 17, 18, 31, 32, 33, 34, 48, 49A, 49B, Portion of Tract 64, Lake Highlands. It was explained that this change would extend the development pattern estab- lished by the Grandview Apartments. Most of this property would logically be served from Grand Highway and Pitt Street, and not U.S. 27 because of the slope. Jay Vander Meer was present and opposed this change. A letter from Dennis Crowther in opposition to these changes was also discussed. Mr. Vander:Meerstated that he would soon be developing a small commercial complex in this area with access from Highway 27. He also discussed the many possibilities for this area, including access roads and believed that the C-2 zoning was necessary to preserve the owners' flexibility. Mr. Lucas spoke in support of Mr. Vander Meer's comments. WORKSHOP: After much discussion, it was decided that all of the above changes would be reviewed at a Planning and Zoning Workshop.
