10-06-1981 MeetingCITY OF CLERMONT MINUTES PLANNING AND ZONING October 6, 1981 This meeting of the Planning and Zoning Commission was called to order at 7:33 p.m. on October 6, 1981 in the City Council Chambers by Vice Chairman Henry Czech, who then presented the Invocation. ROLL CALL: Present: Ann Ritch, Adelbert Evans, Albert Fogle, Henry Czech, Bob Thompson, Nick Jones and Jack Sargent. Absent: Chairman Ruth Alice Ray and Louise Relyea. MINUTES of the previous meeting were approved as written. CONDITIONAL USE PERMIT: Carle Bishop requested a Conditional Use Permit to manufacture paint in a C-2 zone. City staff member Marilyn George stated that the City Ordinance allows manufacturing in a C-2 zone only if the following conditions can be met: 1. Such manufacturing employs not more than five (5) persons. 2. The manufacturing is incidental, complementary, and in conjunction with a retail business or service. The Clermont Zoning Ordinance also states that a Conditional Use Permit may be granted only if: 1. The proposed use is desirable at the particular location. 2. The use will not be detrimental to the health, safety, or general welfare of persons working or residing in the vicinity. 3. The proposed use will comply with the regulations and conditions in the City Codes for such use. 4. The Conditional Use will not adversely affect the officially adopted Comprehensive Plan of the City. A letter of objection to the proposed use from adjacent property owner David A. Johnson was read. In response to the letter, Mr. Bishop stated that the proposed use will cause no traffic or parking problems or unsightly use, and that no hazardous material will be used. Mr. Evans asked about the chemical make-up of materials to be used, and was told that a consulting chemist will be training the personnel. Mr. Sargent inquired about atmospheric pollution and was told that there will be no such problem. Mr. Evans was assured that necessary safety equipment will be used. It was moved and seconded that it be recommended to City Council that this Conditional Use Permit be granted subject to the following conditions: 1. The property be developed in accordance with the attached site plan. 2. Any further construction or expansion must be approved by a CUP. 3. This permit shall expire if a Certificate of Occupancy has not been issued within one year of the date of this permit. 4. All applicable rules and regulations must be met, including retail sales on location and being open for business during normal store hours, and not more than five (5) employees may be utilized in the manufacturing process. CITY OF CLERMONT MINUTES PLANNING AND ZONING October 6, 1981 Page two 5. A Certificate of Occupancy for the above development shall not be issued until all of the above conditions have been met. 6. This permit is not transferable to any other business, or for any other manufacturing use other than the manufacture (blending process only) of paint, the operation of which must be performed within the completely enclosed building. 7. Off-street parking must be provided for employees and customers. If, at a future date, parking proves inadequate, the City Council may require additional off-street parking spaces or rescind this Conditional Use Permit. Mrs. Ritch suggested that a letter be written to Mr. Johnson to explain that this use will not affect the value of his property. The motion passed unanimously. The meeting adjourned at 7:58 p.m. addressed minutes: On October 9, 1981 Adelbert Evans asked that the following questions to Mr. Bishop's chemical consultant be incorporated into these 1. What will be the total process, step by step, involved at the location cited? e.g., If paint is to be manufactured, will monomer to polymer reactions be involved? Monomers are uni- formly toxic, while polymers are seldom poisonous.) (b) What type of instrumentation will be used for emulsification? What, if any, byproducts can be expected from the processing? 2(a) If paints are received at the site .from an outside manufacturer and only mixed or blended at this location, what emulsifying agents will be used to render the latex or acrylic bases water soluble? 3(a) What pigment compounds are to be used? (b) If silicates, anilines, or azo coloring agents are to be em- ployed, what air filtration system is contemplated for ambient atmosphere? Will workers be equipped with breathing apparatus or face masks? 4. Note that the CUP requires that not other than water soluble shall be utilized.
