This meeting of the.Planning and Zoning Commission was called to
order by Chairman Ruth Alice Ray at 7:30 p.m. on Tuesday, July 7, 1981 in the
City Council Chambers. The invocation was asked by Chairman Ray.
ROLL CALL. Present: Chairman Ruth Alice Ray, Vice Chairman Henry
Czech, Jack Sargent, Bob Thompson, Adelbert Evans, Nick Jones, and Albert Fogle.
Absent: Louise Relyea and Ann Ritch.
MINUTES of the previous meeting were approved as written.
CITY-COUNTY PLANNING REPORT. The City Manager reported that the
County Planning Department is assessing the road situation and will contact
the City in September regarding traffic relief for South Lake Shore Drive.
CONDITIONAL USE PERMIT. The City Manager explained, for the bene-
fit of the twelve citizens attending, the reasons for a Conditional Use Permit
and the City Ordinance providing for such use. He recommended that if the C.U.P.
is granted, it be subject to the following conditions:
1. A landscape buffer strip shall be provided on the north and south
property lines.
2. The property shall be developed in accordance with the site plan.
3. This permit shall expire if construction has not begun within one
year of the date of this Conditional Use Permit.
4. Fire hydrants shall be installed to facilitate a direct hose lay
not to exceed 500 feet from hydrant to all buildings.
5. Fifty-seven parking spaces may be allowed, on the condition that if,
at a future date, parking problems arise at this location, the owner
shall provide up to 76 parking spaces at his expense. The owner
agrees that up to 76 spaces will be constructed if requested by a
formal resolution of the City Council, and a covenant on the property
will be recorded to reflect this fact.
6. Any further construction or expansion must be approved by a Condition-
al Use Permit.
7. All applicable rules and regulations must be met, including final site
plan approval and landscaping.
8. A Certificate of Occupancy for the above development shall not be
issued until all of the above conditions are met.
9. The costs of any alterations to the City sewer lift station made
necessary by this development shall be paid by the developer.
Condev Properties, the developer,. was represented by Joe Gardner, who described
the project as a 38 unit apartment complex for the elderly, and answered ques-
tions from interested citizens. Questions covered landscaping, leases, manage-
ment, children, and canal use.
Ann Ritch entered the meeting at this point.
Mr. Gardner responded that leases will be required, and will be the same as

those used in their development in Eustis. There will be a manager who lives
on the site. Children will not present a problem since, in their experience,
all units are occupied by the elderly. Landscaping will be done according to
the Landscape Ordinance, and the canal will be used mainly as a buffer.
Mr. Evans asked about drainage and percolation and was assured that
proper provision would be made.
RECOMMENDATION. It was moved, seconded, and unanimously approved
that recommendation be made to City Council that the Conditional Use Permit be
granted, subject to the nine conditions previously suggested and the following
additional conditions:
1. That the Conditional Use Permit in the Lakeview Hills area for this
development be revoked. (Resolution 358)
2. That additional parking spaces be indicated on the site plan.
Jack Sargent asked that the record show that he would sign a Conflict of
Interest form since he is the real estate salesman involved with this property.
FINANCIAL DISCLOSURE FORMS. The Commissioners were asked to
return completed Financial Disclosure Forms to the City Clerk.
The meeting was adjourned at 8:15 p.m.
