1955-11This Agreement entered into the day of August, 1955, by
the WHITMIRE TANK COMlPANY, INC. JACKSONVILLE, FLORIDA, here-
inafter called the Contractor, and the CITY OF CLERMONT, CLER-
MONT, FLORIDA, hereinafter called the Owner, witnesseth that
the parties do hereto agree as follows:
ARTICLE 1. scope of the Work. The Contractor shall furnish and
erect on the owner's foundations at Clermont, Florida, one used
100,000 gallon tank on a 90'0" tower with an.8" diameter riser
pipe in strict accordance with the attached proposal marked
Exhibit "A" and the.attached blueprint marked Exhibit "B".
ARTICLE 2. Time of Completion. The work performed under this
contract shall be commenced within 10 days after the above
date and shall be substantially completed within 90 days from
the above date. .
ARTICLE 3. Contract sum. The Owner shall pay the Contractor
for the performance of the Contract, subject to additions and
deductions provided therein, in current: funds as follows:
ARTICLE 4. payment to the Contractor. The Owner shall pay the
Contractor 50% of the Contract Sum on the delivery of the tank
material to the erection site. The Owner shall pay the Contract-
or the balance (50%) of the Contract Sum upon the completion of
the Contract..
ARTICLE 5. Guarantee. The Contractor shall guarantee the tank
for a period of one year from the date of the completion of
the erection. Any corrections required to the tank due to.any
faulty workmanship or material will be made at the Contractor's
expense during this period. This guarantee does not include
Acts of God, vandalism or riot.
ARTICLE 6. Changes and Extras. There will be no changes or ex-
tras made by the Contractor. Any changes or extras shall be
made with the full agreement of the Contractor and the Owner.
The cost of any changes or extras are' to be added to the Con-
tract Sum..
ARTICLE 7. Insurance. The Contractor shall furnish the Owner
with Insurance Certificates of Workmen's Compensation and
Manufacturers and Contractors Liability in.the amount of
$100,000 - $300,000 and $lOO,OOO Property Damage.
ARTICLE 8.. Government Regulations. This Contract is subject to
any and all Government Rules and Regulations now in effect or
that may be passed in the future pertaining to the usuage of
steel required for this tank. .
IN WITNESS WHEREOF, the parties hereto have executed this a-
greement the day and the year first above mentioned.

Gentlemen:
ALL AGREEMIlNTS ARE CONTINGIlNT UPON STRIKES. ACCIDENTS OR OTHER DELAYS UNAVOIDABLE OR BElYOND OUR CONTROL
We propose to furnish the required labor, material, equipment
and insurance required to furnish and erect on your foundations
at Clermont, Florida, one used 100,000 gallon tank on a 90'0"
tower to the bottom with an 8" diameter riser pipe for the lump
sum price of EIGHTEEN THOUSAND ONE HUNDRED AND NINETY FIVE DOL~
LARS ($ 18,195.00)..
This tank will be of the following dimensions and specifications:
Diameter - 22'0"
Height on shell -28'0"
Depth of hemispherical bottom - 11'0"
3/16" conical roof with revolving ladder., finial & hatch
Standard steel balcony with handrailing
Ladders on inside and outside of tank and on tower
8" diameter riser pipe, base ell and expansion joint
4" diameter stub overflow; screened
Water level indicator.
After the tank has been erected, we will test the tank with
water to be furnished by you and make the tank tight and free
of leaks.
We do not propose to do any cleaning or painting of the tank
prior to or after the erection.
Delivery- 90 days after receipt of the written order.
We will furnish a foundation and erection diagram and the
anchor bolts required for the installation of .the foundations.
