ORDINANCE No. 2010-O1-C
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
CLERMONT, LAKE COUNTY, FLORIDA AMENDING SECTION 2-76 OF
THE CODE OF ORDINANCES PERTAINING TO THE CITY'S PLANNING
AGENCY; PROVIDING FOR A DECREASE IN MEMBERSHIP FOR THE
PLANNING AND ZONING COMMISSION FROM TEN (10) MEMBERS TO
EIGHT (S}; PROVIDING FOR ONE MEMBER TO BE RECOMMENDED BY
THE LAKE COUNTY SCHOOL BOARD; AMENDING SECTION 2-81
QUORUM REDUCING QUORUM FROM FIVE TO FOUR MEMBERS;
PROVIDING FOR CODIFICATION; SEVERABILITY AND AN EFFECTIVE
DATE.
WHEREAS, the Planning and Zoning Commission serves as the local planning agency for
the City of Clermont, Lake County, Florida and;
WHEREAS, the City of Clermont, Florida recognizes the responsibility to provide quality
education and realizes the advantages of having a representative of the Lake County School Board on
the Planning and Zoning Commission to provide information regarding school capacity and other
related issues.
NOW THEREFORE, BE IT ORDAINED by the City Council of the City of Clermont,
Florida as follows:
SECTION 1:
The City Council of the City of Clermont, Lake County, Florida has the authority to adopt this
Ordinance pursuant to Article VIII of the Constitution of the State of Florida and Chapter 163 and
166, Florida Statutes.
SECTION 2:
The City of Clermont Code of Ordinances is hereby amended to read as follows:
Section 2-76. Membership.
(a) The Planning and Zoning Commission, provided for in this division, shall be
comprised of eight members. Seven members to be appointed by a majority vote of
the City Council at its first regular meeting in January of each year, or as soon as
possible thereafter, and one member recommended by the Lake County School
Board. The member recommended by the Lake County School Board shall serve at
the pleasure of the Lake County School Board.

(b) Seats for the Planning and Zoning Commission shall be numbered one through eight.
The term of each commission member shall be for two years.
SECTION 3: Codification.
The provisions of Section 2 of this Ordinance shall be codified as and become and be made a part of
the Code of Ordinances of the City of Clermont. The Sections of this Ordinance may be renumbered
or re-lettered to accomplish such intention and the word "Ordinance", or similar words, may be
changed to "Section," "Article", or other appropriate word. The Code codifier is granted liberal
authority to codify the provisions of this Ordinance.
SECTION 4: Severability.
Should any section or part of a section be declared invalid by any court of competent jurisdiction,
such applications shall not apply or affect any other provision of this ordinance, except to the extent
that the entire section or part of the section may in separable in meaning and effect from the section
to which such holding shall apply.
SECTION 5; Effective Date.
This ordinance shall be published as provided by law, and it shall become law and take effect upon
its second reading and final passage.
PASSED AND ADOPTED BY the City Council of the City of Clermont, Florida on this
