AMENDMENT NO. 01
THIS AGREEMENT as entered into on the 3rd day of November, 1995, between the
Department of Environmental Protection (hereinafter referred to as the
"Department") and the City of Clermont (hereinafter referred to as the
"Contractor") .
WITNESSETH:
WHEREAS, the original design for this project was based upon mailing
addresses included in the Agreement; and,
WHEREAS, during the construction of the water lines it was discovered that
seven (7) of the residences were actually located on an unnamed road
approximately 1200 feet north of their Johns Lake address; and,
WHEREAS, it is necessary to extend the water line to connect these
residences; and,
WHEREAS, it is therefore necessary to amend this Agreement to add the
additional sites and to add additional funds for the water line extension.

NOW, THEREFORE, this Agreement is hereby amended as follows:

Item 4 is hereby revised to increase the maximum compensation for the cost
reimbursement portion of this Agreement from $219,520.00 to $277,394.03 (an
increase $57,874.03). The maximum compensation under this Agreement is
hereby increased from $280,000.00 to $337,874.03 (an increase of
$57,874.03).
Delete Item 9, on Page 3 and replace it with the following:
In accordance with Section 215.422, Florida Statutes, the Department shall
pay the Contractor interest at a rate as established by Section 55.03 (1) ,
Florida Statutes on the unpaid balance, if a warrant in payment of an
invoice is not issued within 40 days after receipt of a correct invoice and
receipt, inspection, and approval of the goods and services. The interest
rate established pursuant to Section 55.03(1), by Comptroller's Memorandum
No. 9 (1994-95) dated December 1, 1994, has been set at 8.0% per annum or
.02192% per day. Interest payments of less than $1 will not be enforced
unless a Contractor requests payment. The revised interest rate for each
calendar year beyond 1995 for which the term of this agreement is in effect
can be obtained by calling the Department of Banking and Finance, Vendor
Ombudsman at the telephone number provided in Item 8 (above).
In all other respects, the Agreement
