STANDARD
CONSIRUCTION CONTRACT
THIS AGREEMENT, made and entered into this 25 th day of september ,
A.D. 1957 , between the City of Clermont, Lake County, Florida
hereafter called the OWNER, party of the first part, and
Boykin & Elliot, Clermont, Florida hereafter called the CONTRACTOR, party
of the second part:
WITNESSETH:
That the CONTRACTOR hereby agrees, for himself, his heirs, administrators,
successors and assigns to furnish all labor, material, equipment and incidentals
and perform all work necessary to construct and place in initial operation
street pavement and drainage facilities to be constructed at
Diston Avenue & Palm Lane, Clermont , Lake County, Florida,
complete in all respects and in accordance with the plans and specifications
therefor as prepared by A. E. O'NEALL & ASSOCIATES, Consulting Engineers, Orlando,
Florida. Said plans and specifications are hereby made a part of this Agreement,
and shall have the same force and effect as though all of the same were fully'
inserted herein. '
That the OWNER hereby agrees, for his heirs, administrators, successors
and assigns to pay to the CONTRACTOR for the performance of this contract such
sums as may become due in accordance with the CONTRACTOR'S bid for the work,
as shown on the Bid Form in the specifications, attached hereto. Partial
payments shall be made monthly to the CONTRACTOR as the work progresses, based
on estimates of work completed as of the last day of each month, with estimates
duly certified by the CONTRACTOR and approved by the Engineers. The OWNER shall
retain ten percent of the total amount of each estimate until the final
completion and acceptance of all work required by the Contract, when final
payment will be made to the CONTRACTOR by the OWNER.
If the CONTRACTOR is required by the OWNER to perform addi tional work
not contemplated in the scope of the plans and specifications forming a part
of this Agreement,. or to omit a portion of the work so contemplated, an
equitable adjustment in the contract price shall be made, as agreed' to between
the OWNER and the CONTRACTOR.
. IN WITNESS WHEREOf, the parties hereto have set their hands and seals
in . duplicate agreement this 4th day of October, A.D. 1957 .

The undersigned agrees to start construction of the project within___
calendar days after written notice of award of contract and notice to
proceed, and to guarantee completion of the work within calendar
days thereafter.
The undersigned agrees that he will execute a contract and give bonds as
specified within ten (10) days after the documents have been presented to
him for signature, all in accordance with the specifications.
The Bidder understands that the quantities in this Proposal are approximate
only and subject to increase or decrease, and should they be increased or
decreased, he will perform the work at the unit prices bid herein, Actual
quantities will be determined upon completion of the work.
