R-92-777 · e CITY OF CLERMONT RESOLUTION No. 777 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CLERMONT, LAKE COUNTY, FLORIDA GRANTING A CONDITIONAL USE PERMIT TO ALLOW THE ADDITION OF FOUR (4) BATTING CAGES TO AN EXISTING MINIATURE GOLF COURSE LOCATED IN THE C-2 GENERAL COMMERCIAL BUSINESS DISTRICT. WHEREAS, the Planning and Zoning commission of the city of Clermont, Lake County, Florida at a meeting held December 1, 1992, recommended approval of the Conditional Use Permit to allow the addition of four (4) batting cages to an existing miniature golf course located in the C-2 General Commercial Business District at the following location: 857 E. Minnehaha Avenue The city Council deems it advisable in the interest of the general welfare of the City of Clermont, Lake County, Florida to grant the Conditional Use Permit; NOW THEREFORE BE IT RESOLVED by the City Council of the City of Clermont, Lake County, Florida that: SECTION 1. The application for a Conditional Use Permit to allow the addition of four (4) batting cages to an existing miniature golf course located in the C-2 General Commercial Business District be granted subject to the following conditions: 1. The conditions as set forth in this Conditional Use Permit shall be legally binding upon any heirs, assigns and successors in title or interest. 2. The property shall be developed in substantial accordance with an approved site plan incorporating all conditions of this Conditional Use Permit. Said plans shall be submitted for review and approval of the site Review Committee prior to authorization and issuance of a development permit. 3. The applicant shall provide the Site Review Committee with a development plan that indicates methods, forms and materials that shall be used to ensure acceptable levels of noise buffering and visual screening from adjacent properties. If, at a future date, the noise proves to be excessive, the applicant understands and agrees that the City may require additional noise control or rescind this Conditional Use Permit. 4. If, at a future date, parking at this site proves inadequate, the applicant understands and agrees that the city may require additional parking or rescind this Conditional Use Permit. 5. No further expansion of the use or additions to this facility shall be permitted except as approved by another Conditional Use Permit. 1 e e CITY OF CLERMONT RESOLUTION No. 777 6. All applicable rules and regulations shall be met, including final site plan approval, landscaping, drainage, parking and regulations, and all yard setbacks. All required landscaping be served with a permanent irrigation system and must be maintained. The drainage and stormwater retention requirements the appropriate regulatory agencies must be met, and approved the City Engineer. These areas must be properly maintained. 7. The applicant shall agree facilities between the hours of through Thursday and 9 : 00 a . m. Saturdays. 8. All lighting for the proposed facility shall be designed and located such that light and/or glare shall be directed upon the subject property only. to operate the batting cage 9:00 a.m. to 10:00 p.m., Sunday to 11: 00 p. m. on Fridays and 9. The final certificate of Occupancy cannot be issued until each of the stated conditions has been met. 10. This permit shall expire if construction has not begun within one year of the date of this Conditional Use Permit. 11. If any of the stated conditions are violated, the applicant understands and agrees that the City Council may revoke this Conditional Use Permit by resolution.
