R-92-752 e e CITY OF CLERMONT RESOLUTION NO. 752 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CLERMONT, LAKE COUNTY, FLORIDA GRANTING A CONDITIONAL USE PERMIT TO ALLOW THE CONSTRUCTION OF A PROFESSIONAL OFFICE BUILDING IN THE R-3 RESIDENTIAL/PROFESSIONAL DISTRICT. WHEREAS, the Planning and Zoning Commission of the City of Clermont, Lake County, Florida at a meeting held April 7, 1992, recommended approval of the Conditional Use Permit to allow the construction of a Professional Office Building in the R-3 Residential/Professional District at the following location: Lots 10 through 18, inclusive, city Block 75 The City Council deems it advisable in the interest of the general welfare of the City of Clermont, Lake County, Florida to grant the Conditional Use Permit; NOW THEREFORE BE IT RESOLVED by the city Council of the city of Clermont, Lake County, Florida that: SECTION 1. The application for a Conditional Use Permit to allow the construction of a Professional Office Building in the R-3 Residential/Professional District be granted subject to the following conditions: 1. The property must be developed in substantial accordance with an approved site plan. 2. If, at a future date, parking at this site proves inadequate, the applicant understands and agrees that the city may require additional parking or rescind this Conditional Use Permit. 3. No further expansion of the use or additions to this facility shall be permitted except as approved by another Conditional Use Permit. 4. All applicable rules and regulations shall be met, including final site plan approval, landscaping, drainage, parking and sign regulations, and all yard setbacks. All required landscaping must be served with a permanent irrigation system and must be properly maintained. The drainage and stormwater retention requirements of the appropriate regulatory agencies must be met, and approved by the city Engineer. These areas must be properly maintained. 5. This property may be used only for Professional Offices. No other business operation may be conducted from this facility. 6. Standard sidewalks shall be constructed along both Desoto and Juniata streets. 7. The applicant may develop the facility in phases: however, the final, approved site plan shall indicate the phasing sequence. All requirements for parking, drainage, landscaping, etc., for each phase shall be completed to the satisfaction of the City engineer prior to the initiation of construction for any subsequent phases. 1 e e CITY OF CLERMONT RESOLUTION NO. 752 8. The applicant may utilize nine (9) feet by eighteen (18) feet, double striped parking spaces upon submission and approval of a parking variance granted by the city Council. 9. The final certificate of Occupancy cannot be issued until each of the stated conditions has been met. 10. This permit shall expire if construction has not begun within one year of the date of this Conditional Use Permit. 11. If any of the stated conditions are violated, the applicant understands and. agrees that the City council may revoke this Conditional Use Permit by resolution.
