R-91-714! ~ CITY OF CLERMONT RESOLUTION No. 714 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CLERMONT, LAKE COUNTY, FLORIDA, EQUALIZING SPECIAL ASSESSMENTS ON REAL PROPERTY BENEFITTED BY IMPROVEMENTS TO DISSTON AVENUE; APPROVING AND CONFIRMING EQUALIZATION; PROVIDING FOR LEGAL VALID AND BINDING FIRST LIENS UPON THE PROPERTY AGAINST WHICH SPECIAL ASSESSMENTS ARE MADE UNTIL PAID. WHEREAS, the City Council did cause an Assessment Plat to be prepared which indicates the areas to be assessed, plans and specifications, and estimate of proposed costs. WHEREAS, the City Council did enact Resolution No. 712 which stated the nature of the proposed improvements, the streets to be improved, the portion of improvements to be paid by special assessments, the manner of payment, when payments are due, which lands were to be assessed and the total estimated cost, and WHEREAS, the City Council did cause said Resolution to be published as required by law, and WHEREAS, the City Council did cause an Assessment Roll to be prepared as required by law and filed with the City Clerk, and WHEREAS, the City Council did enact Resolution No. 713 which provided for a Public Hearing on the propriety and advisability of making such improvements, the cost thereof, the manner of payment, and the amount to be assessed against each parcel, and WHEREAS, the City Council did cause a Notice of Hearing to be mailed to property owners and published as required by law, and WHEREAS, the City Council did hold a Public Hearing as required by law on June 11, 1991, and did approve the levying of the special assessment, and WHEREAS, the City Council did sit as an Equalizing Board as required by law. NOW, THEREFORE, the City Council of the City of Clermont, hereby resolves that: 1. A special assessment on real property benefitted by improvements to Disston avenue in the City of Clermont is hereby equalized, approved and confirmed. 2. The Final Assessment Roll is attached hereto and made a part hereof. 3. Such Assessments and Final Assessment Roll shall stand confirmed and shall remain legal, valid and binding first liens upon the property against which such assessments are made until paid. 4. The manner of payment is provided for in Resolution No. 712 and in the Final Assessment Roll. C~ CITYOF CLERMONT RESOLUTION No. 714 Page -2- 5. The City Clerk is directed to record this Resolution and attached Final Assessment Roll in the Public Records of Lake County, Florida.
