R-90-661• • CITY OF CLERMONT RESOLUTION No. 661 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CLERMONT, LAKE COUNTY, FLORIDA GRANTING A CONDITIONAL USE PERMIT TO CONSTRUCT TWO (2) DUPLEX TOWNHOMES IN THE R-2 MEDIUM DENSITY RESIDENTIAL DISTRICT. WHEREAS, the Planning and Zoning Commission of the City of Clermont, Lake County, Florida at a meeting held April 3, 1990, recommended approval of the Conditional Use Permit to construct two (2) duplex townhomes in the R-2 Medium Density Residential District at the following location: North 100 of the east 300 of lot 14, Block BB. The City Council deems it advisable in the interest of the general welfare of the City of Clermont, Lake County, Florida to grant the Conditional Use Permit; NOW THEREFORE BE IT RESOLVED by the City Council of the City of Clermont, Lake County, Florida that: SECTION 1. The application for a Conditional Use Permit to construct two (2) duplex townhomes in the R-2 Medium Density Residential District be granted subject to the following conditions: 1. The property must be developed in substantial accordance with an approved site plan. 2. If, at a future date, parking at this site proves inadequate, the applicant understands and agrees that the City may require additional parking or rescind this Conditional Use Permit. 3. No further expansion of the use or additions to this facility shall be permitted except as approved by another Conditional Use Permit. 4. All applicable rules and regulations shall be met, including final site plan approval, landscaping, drainage, parking and sign regulations, and all yard setbacks. All required landscaping must be served with a permanent irrigation system and must be properly maintained. The drainage and stormwater retention requirements of the appropriate regulatory agencies must be met, and approved by the City Engineer. These areas must be properly maintained. 5. This property may be used for 2 duplex townhomes (4 units) only. No other business operation may be conducted from this facility. 6. Existing mobile home shall be removed either 6 months after the Building Permit has been issued or 30 days after the first Certificate of Occupancy has been issued, which ever occurs first. 1 • • RESOLUTION NO 661 7. Proper easement to be executed for ingress and egress for all units. 8. A twenty (20) foot utility easement to the City shall be executed along the north property line. 9. Driveway access is limited to either one 20' drive or two 10' drives with approved curbing. 10. St. Johns River Water Management District stormwater permit shall be obtained. 11. The final Certificate of Occupancy cannot be issued until each of the stated conditions has been met. 12. This permit shall expire if construction has not begun within one year of the date of this Conditional Use Permit. 13. If any of the stated conditions are violated, the applicant understands and agrees that the City Council may revoke this Conditional Use Permit by resolution.
