1970-06CONTRACT This Cont.ract. made the 11th day of August, 1970 between Lake County a political subdivision of the State of Florida, hereinafter referred t.o as the Count.y, and the Tax Assessor of Lake County, hereinafter referred to as Tax Assessor: and the Tax Collector of Lake County, herein after referred to as Tax Collector; and the City of CLERMONT, County of Lake, State of Florida, a municipal corporation under the Laws of the State of Florida, hereinafter referred to as the City. WHEREAS, Chapter 69-54 ( House Bill No.. 1082, Laws of the State of Florida, provides that all ad valorem taxes levied by municipalities shall be assessed by the County Tax Assessor and collected by the County Tax Collector of the County in which the municipalities are located. and: WHEREAS, Chapt.er 69-54, Laws of Florida, provides that. the governing body of the County or ot.her concerned County Officials shall have a contract with each municipality within the County to compensate the offices of the County Tax Assessor and County Tax Collector, WITNESSETH; That the parties to this Agreement and Contract. in consideration of the payments to be made and the services to be performed as hereinafter stated, contract and agree as follows: 1. That the County Tax Assessor shall assess all property for the city for the year 1970 and thereafter. 2. That the County Tax Collector shall collect all property taxes for the city for the year 1970 and thereafter.. 3. That Special Assessment Liens shall continue t.o be assessed and collected as provided for under applicable City Charter or Special Act, which now exists or may become law. 4. The County Tax.Assessor shall assess all property subject to taxation under the Constitution and General Laws of the State within the City, and all such property shall be assessed at its just value. 5. That each year within 15 days after. the assessment roll has been equalized and returned to the County Tax Assessor, the Tax Assessor will certify to the City the total assessed valuations of all property within the City, and the City shall have thirty (30) days in which to certify to the County Tax Assessor the millage or millages to be levied for all purposes for that year for the City. 6.. The County Tax Assessor shall extend. the Tax Roll as required under the General Laws of Florida; and the Tax Roll shall then be endorsed by Certificate by the County Commissioners and transmitted to the County Tax Collector. There shall be a .Notice by the Tax Collector showing the millagesfor each taxing authority sent with the Tax Bill as provided in Para.- graph 8.. 7. The Tax Assessment Roll shall be reviewed and equalized each year by the County in accordance with the laws of the State of Florida. 8. The County Tax Collector shall collect all property taxes levied. by the City: and shall show on a printed notice, accompanying the tax statement, required by Florida Statutes 197.065 the rate of taxation by the City.. 9. The County Tax Collector shall enter into a Bond with good and sufficient surety v conditioned to duly and faithfully account for the taxes collected by him under this Contract. and the form, amount and surety of the Bond shall be approved by the Ci ty . The Ci ty shall pay the Bond premium for the bond under this Contract. 10. The County Tax Collector shall pay to the City the taxes collected for the City in. the same manner as the County Tax Collector. does for County and School Taxes. 11. The Taxes levied and assessed under the Tax Assessment Roll for the City shall be due and payable at the same ,time and with the same. discounts. and penalties as County Taxe's. 12. The City shall pay to the County Tax Assessor the sum .. of one--half of one percent (.5% of Taxes assessed on the Tax Assessment Roll for the City; as compensation to the County Tax Assessor for his services, each year. Said sum shall be due and payable to the County Tax Assessor in accordance with Florida Statutes. 13. The City shall pay to the County Tax Collector the sum of one~half of one percent (.5%) of taxes collected and remitted to the City of the Tax Assessment Roll for the City as compen sation to the County Tax Collector for his services. each years. Said sum shall be due and pay&)le to the County Tax Collector thirty (30) days after each remittance by the County Tax Collector to the City. 15. The County Tax Collector shall pay funds collected for the City directly to a depository designated by the City in accordance with Florida Statutes. 16. That this instrument contains the entire agreement between the parties, and that no statement, promise or induce ment made by any party hereto; or agent of any party hereto. which is not contained in this written Contract, shall be valid or binding and this Contract may not be enlarged modified or altered except in writing signed by the parties and endorsed hereof. except as set forth herein in Paragraph 18. 17 . That this Contract shall inure to the benefit of and be binding upon the successors of the respective parties hereto. 18. That this contract is subject to modification by Amendment or Alteration of the General Law of the State of Florida, and it is agreed that the parties will modify this Agreement to comply with future Amendments or changes in the General Law of the State of Florida regarding the Tax Assess ment and Collection of Municipal Taxes by County Officials.
