WHEREAS, the United States Army did occupy certain property
in the City of Clermont lying North and South of, and adjacent
~ to, Juniata Street and being bounded on the East by Tenth street
...
and on the west by 12th Street and during such occupancy closed
to the general public Juniata street between Tenth street and
12th street; and,
WHEREAS, during the occupancy of the premises hereinabove
described by the members of the United states Army, the said
Juniata !treet, between Tenth Street and 12th Street, was used
by the United States Army to the exclusion of all others; and,
WHEREAS, a great deal of damage has been done to Juniata
street by the trucks and various other equipment of the United
States Army and therefore such street is in an unusable con-
dition by reason of the exclusive use of heavy equipment by
the United states Army; and,
WHEREAS, the City Council of the City of Clermont and the
Mayor of the City of Clermont have taken up the matter with the
Unites States Army and whereas it is the desire of the City
Council to file a claim with the United states Army for the
damage done to this Street and to authorize the Mayor mf the
City of Clermont to proceed with the filing of such claim;
THEREFORE, BE IT RESOLVED by the City Council of the City
of Clermont that the Mayor and the City Clerk of the City of
Clermont are hereby duly authorized and empowered by the City
Council of the City of Clermont to file a claim with the United
States Army for the damage done to Juniata StDeet during the
occupancy and use of said street by the United states Army and
to be assisted in the filing of said claim and the proceeding
with the conclusion and settlement of the claim by the City
Attorney of ~e City of Clermont.
BE IT FURTHER RESOLVED that three (3) certified copies of
this Resolution be forwarded to the Mayor of the City of Clermont
by the Clerk of the City of Clermont.
