No. 376-M
AN ORDINANCE OF THE CODE OF ORDINANCES OF THE CITY OF CLERMONT,
LAKE COUNTY, FLORIDA, CLOSING AND PERMANENTLY ABANDONING THAT
PORTION OF THIRD STREET LYING NORTH OF STATE ROAD 50 AND LYING
SOUTH OF CRYSTAL LAKE DRIVE, CITY OF CLERMONT, LAKE COUNTY,
FLORIDA, RECORDED IN PLAT BOOK 8, PAGES 17 TO 23 INCLUSIVE, PUBLIC
RECORDS, LAKE COUNTY, FLORIDA; RESERVING TO THE CITY OF
CLERMONT AN EASEMENT FOR INGRESS EGRESS, AND MAINTENANCE,
UTILITIES, SANITARY SEWER AND STORMWATER; REPEALING ALL
ORDINANCES IN CONFLICT HEREWITH, PROVIDING FOR SEVERABILITY,
PROVIDING FOR PUBLICATION AND PROVIDING FOR AN EFFECTIVE DATE.
The City Council of the City of Clermont, Lake County, Florida hereby ordains that:
SECTION 1:
That portion of Third Street lying north of State Road 50 and lying south of Crystal Lake
Drive located within the City of Clermont, Lake County, Florida is hereby closed and permanently
abandoned.
Reserving to the City of Clermont an easement for ingress and egress, maintenance, utilities,
sanitary sewer and stormwater within said roadway.
SECTION 2:
This closing is done pursuant to the authority of the Charter of the City of Clermont, Lake
County, Florida and the general laws of the State of Florida.
SECTION 3:
All ordinances or parts of this ordinance in conflict herewith are hereby repealed.
SECTION 4:
Should any section or part of this section be declared invalid by any court of competent
jurisdiction, such adjudications shall not apply to or affect any other provision of this Ordinance,
except to the extent that the entire section or part of the section maybe inseparable in meaning
and effect from the section to which such holding shall apply.
