1962-01Cleaning Scaling Inspecting & Painting Agreement AMERICAN TANK & TOWER COMPANY JOPLIN, MISSOURI STEEL TANK CONSTRUCTION ENGINEERING MAINTENANCE QUOTATION BID Tank Owner City of Clermont Date Sept 20, 1962 Capacity of Tank(s) 50,000 gallons 100,000 gallons Located at CLERMONT, FLOR IDA American Tank & Tower Co. proposes to furnish labor and equipment to complete work specified below: INTERIOR: Electric power scaled to clean off all loose paint, rust and corrosion. Apply one (1) coat of TANKAMASTIC reliner. All interior coatings to be furnished by American Tank & Tower Co. EXTERIOR Company will remove all loose rust and paint from exterior of tank and tower, apply one (1) spot coat to all bare metal, and apply one (1) complete coat of paint to the exterior of tank and tower, all from the founda- tion up. All exterior paint is to be furnished by AMERICAN TANK AND TOWER CO and Exterior Paint to be First Grade Quality. Tank Owner agrees to block off streets, alleys, or other areas to prevent automobiles from parking where they might become damaged from falling paint. Work to be in complaince with AAWA Spec Total price for work and materials as specified above $1,635.00 Terms: Net cash, upon completion. $700.00 FOR THE 50,000 GALLON $935.00 for the 100,000 gallon INSURANCE: American Tank & Tower Co. to furnish workmen's compensation, public liability and property damage insurance and tank owner agrees to cooperate by restricting traffic under his control with signs, barricades, or notification in areas where paint may fall during painting operation. INSPECTION: American Tank & Tower Co. to furnish an inspector at no additional cost to assist tank owner in inspect- ing tank following interior cleaning. Any work or repairs in excess of work specified above which tank owner elects to do, shall be done by American Tank & Tower Co., under a supplement agreement. Tank owner agrees to render decisions promptly so as not to delay workmen. GUARANTEE: American Tank & Tower Co. shall guarantee the tank against leaking, and if it does to repair any leaks without charge, under its standard written 12 year guarantee, if all repairs recommended by its inspector are authorized, but shall not be responsible for leaks resulting from cleaning if repairs are not authorized. Tank owner will inspect all work as it progresses, and make a final inspection, as American Tank & Tower Co. crews are not permitted to leave the job until tank owner approves the completed work. To insure maximum paint life, tank owner agrees not to place water in tank until interior coating is dry. Electric current required for operations will be fur- nished by tank owner. American Tank & Tower Co. agrees to expedite all work but acts of God, accidents, or other factors beyond American Tank & Tower Co.'s control shall be considered in completion time. No verbal representations will be binding on either party. Tank Owner's Acceptance: Date AMERICAN TANK & TOWER COMPANY Tank Owner's Signature Title: Emergency Repair Contract of AMERICAN TANK & TOWER COMPANY JOPLIN, MISSOURI THIS CONTRACT entered into for emergency repairs to water tanks by and between Board of Trustees authorized agent of City of Clermont, hereafter known as Tank Owner, and the American Tank & Tower Co., of Joplin, Missouri, hereinafter known as the Company. WITNESSETH: It is understood and agreed between the parties that a thorough inspection has been made of the 50000 Gallon tank belonging to the Tank Owner located at Clermont Fla (excluding the footings or foundation of the tank) and that the repairs outlined in the following paragraphs have been agreed upon by the parties as be- ing necessary and essential. 1- (a) —It is understood and agreed between the parties that the Company shall do the following repair work upon said tank for the price hereinafter stated: Total amount of lineal feet of flat welding 20 feet of seam on saucer Total amount of lineal feet of vertical welding None Total amount of lineal feet of horizontal welding None Total number of rivets to be welded 160 rivets in saucer Total amount of pits to be welded approximately 4500 to 5000 Total Leg Posts to be welded. None Total Sway Rods to be adjusted check swayrods and adjust if needed Tightening of rods, new steel, etc., or any miscellaneous list below: Strengthen const roll by reinforcing with new steel, patch hold in cont Walk, and kitty walk 1-(b) —The C Company agrees to furnish all labor and weldin rods, necessary under this contract. The Tank Owner agrees to furnish all electric current necessary to perform this contract. Tank Owner shall furnish all and other materials unless otherwise specified. 2 —The tank owner shall pay to the Company, upon completion of the work agreed to be performed, the sum of $3456.00 which shall be in full for all work performed and agreed to be performed by the Company under this contract. Payment to be given to Company Foreman by check made payable to American Tank & Tower Co. 3 —The Company specifically requests the Tank Owner to have an inspector in the tank at all times while work is in progress, and Tank Owner agrees to notify the Company of any defects in workmanship and materials used, if any such defects shall arise while work is in progress, or during the period of the guarantee hereinafter mentioned; and the Company agrees to make all proper adjustments within a reasonable length of time after such notice, all such proper adjustments- to be without cost or further obligation on the part of Tank Owner. 4—It is agreed that the Company shall have the right to install outlets in the tank for ventilation or cleaning purposes. 5 —It is agreed that the Tank Owner shall pay the Company at the rate of three dollars ($3.00) per man hour for any delays or waiting time including waiting for payment after work is completed or other delays which may be caused by the Tank Owner, which shall be in addition to the sum set forth in paragraph (2) above. Waiting time is to be computed at the rate of eight (8) hours per day out of every twenty -four (24) hours as defined by a calendar day. Such waiting time is not to be effective for eight (8) hours after Company has notified the Tank Owner that the crew is ready to start work or has completed work. However, this waiting time clause shall become effective eight (8) hours after Tank Owner has been noti- fied the crew is ready to work or has completed work if any delay is then caused by Tank Owner. 6 —The Company agrees to furnish all necessary tools and equipment, and agrees to carry full coverage of Workmen's Compensation and Contractor's Public Liability Insurance, and agrees to furnish verification to the Tank Owner that such in- surance policies are in force and effect if the Tank Owner shall request it. 7 —Tank Owner shall report any disorderly conduct of the foreman and men by collect telegram- to the Joplin Office and the Company shall remove them immediately upon such notification. The Company shall keep the premises clean and shall remove all trash and used materials placed there by the Company during the performance of this contract. 8 —The Company upon payment for the work performed under this contract being received at Company's Joplin, Missouri Office will issue its Standard Form of Warranty warranting all repair work and materials used in the performance (Continued on Reverse Side) this contract under the provisions of the Company's Standard Form of Warranty No Warranty will be issued and no war- ranty or guarantee shall be binding upon Company until full payment under this contract is received by Company at its Jop- lin, Missouri Office This warranty shall extend for a period of twelve (12) years from the date the repairs under this contract are completed, provided the inside of said tank is painted by the Company at the expiration of four (4) years from the date of which repairs with Tankamastic Tank Reimer, or paint of equal quality approved by the Company, and the outside painted with first grade paint of any reliable paint manufacturer. The Company warrants the painting inside for a period of four (4) years from the date the painting is completed. As a part of this warranty or guarantee and of this contract, the Company agrees to make yearly inspections of the tank and necessary adjustments thereto, without cost or obligation, to the Tank Owner, such inspections to continue for four (4) years from the date of completion of the work under this contract, and such warranty and inspection will continue for another four (4) years in the event the Company shall re -paint said tank at the expiration of four (4) years from the completion of the work done under this contract Tank Owner shall dram tank for inspection within twenty -four (24) hours after notice that adjustment crew will arrive. In the event a cathodic or electrolytic devise is installed in the tank after the repairs are made and while the warranty and yearly inspection provisions of the contract shall be in force, then the installation of such device shall termin- ate the guarantee and yearly inspection clauses, and shall operate to release the Company from any further liability by reason of this contract It is understood and agreed by the parties that no inspection has been made by the Company of the concrete foot - ings foundation or building that tank may rest on, and no work whatever has been done thereon by the Company, any de- fects therein — either latent or patent —are expressly excluded from the provisions of this contract and warranty and are the sole responsibility of the Tank Owner The party or parties signing this contract on behalf of Tank Owner covenant and agree that they are fully author- ized and empowered to sign, execute and deliver the same, and that all legal requirements have been fully complied with. No verbal agreements or representations, not incorporated in this contract, shall be binding on either party as this contract contains the entire agreement. It is agreed that any construction of this contract shall be governed by the laws of the state that work will be performed in.
