INSTRUMENT #2011085803 cRA/ eity, o f" na "t OR BK 4071 PG 278 - 280 (3 PGS) —r' 685 21) .M.wztwoe St D ; „t, s e 34711 DATE 9/9/2011 8 57 17 AM NEIL KELLY, CLERK OF THE CIRCUIT COURT LAKE COUNTY RECORDING FEES $27 00 FIRST ADDENDUM TO AGREEMENT BETWEEN KINGS RIDGE AND CITY OF CLERMONT This Addendum is to that certain Agreement dated July 8, 2003 (the Agreement), between CITY OF CLERMONT, hereinafter referred to as "City" and the LENNAR LAND PARTNERS, L.L.C., Florida, hereinafter referred to as "Lennar" as assigned by Lennar to KINGS RIDGE COMMUNITY ASSOCIATION, INC., hereinafter referred to as "Kings Ridge" on October 23, 2006. WHEREAS, the Parties have entered into the Agreement for the purposes set forth therein; and WHEREAS, except as may be amended herein, the parties do hereby readopt and restate herein, the recitals set forth in the Preamble to the Agreement; and WHEREAS, the Agreement provides that the City may provide bulk reclaimed water to Kings Ridge for the use of irrigation water; and WHEREAS, the City and Kings Ridge desire to add a second delivery point for reclaimed water called "the North Pond" and further defines the financial obligations of each party to accomplish the connections; and WHEREAS, the Agreement provides that the terms may be amended by a written amendment authorized and executed by the parties; and NOW THEREFORE, the parties, in consideration of the mutual covenants contained in the Agreement and this Addendum, agree as follows: 1. This Addendum expressly modifies the Agreement and in the event of a conflict, the terms and conditions of this Addendum shall prevail. 2. Provision of Reuse Water Service for King's Ridge Amended. The Parties agree that effective as of the date of this Addendum the point of delivery for reclaimed water as created in the Agreement and defined in Paragraph 3 of the Agreement shall be expanded to include the North Pond referred to above. Furthermore, the Parties agree and acknowledge that Exhibit "A" to this Addendum shall as of the effective date of this Addendum replace in its entirety Exhibit "A" to the Agreement and shall be applicable and govern all references to the Kings Ridge reuse water service contained in the Agreement and this addendum. The connection shall be made to the North Pond in compliance with the engineered plans prepared by BESH, Inc., dated August 10, 2007. The cost of the modifications as shown in the plans shall be borne in entirety by the Kings Ridge Homeowner's Association. 3. All other terms and conditions set forth in the Agreement shall remain in full force 1 and effect and unchanged as agreed to by the parties. 4. This Addendum shall take effect as of the date that the last party executes the Addendum. The City shall cause the executed Addendum to be filed with the Clerk of the Circuit Court of Lake County and recorded in the Public Records of Lake County.
