AN ORDINANCE OF THE CODE OF ORDINANCES OF THE CITY OF CLERMONT,
LAKE COUNTY, FLORIDA, ESTABLISHING A LOCAL PLANNING AGENCY, AND
DESIGNATING THE CITY OF CLERMONT PLANNING AND ZONING COMMISSION AS
THE LOCAL PLANNING AGENCY, PROVIDING FOR SEVERABILITY, PROVIDING
FOR AN EFFECTIVE DATE AND PROVIDING FOR PUBLICATION.
WHEREAS, Florida Statutes, Chapter 163.3174 requires that the
governing body o eac oca government shall designate and establish
a local planning agency; and
WHEREAS, the agency may be the local planning commission; and
WHEREAS, the duties of such agency shall be to carry out the
functions as outlined in said Chapter 163, specifically, the general
responsibility for the conduct of the comprehensive planning program.
NOW, THEREFORE, the City Council of the City of Clermont, Lake
County, Florida, hereby ordains that:
SECTION 1.
A local planning agency is hereby established; and said local
planning commission, otherwise known as the City of Clermont Plan-
ning and Zoning Commission, shall be designated the local planning
agency and shall be responsible for the conduct of the comprehen-
sive planning program as specified in Chapter 163, Florida Statutes.
SECTION 2.
Should any section or part of this section be declared invalid by
any court of competent jurisdiction, such ajudications shall not
apply or affect any other provision of this ordinance, except to
the extent that the entire section or part of the section may be
inseparable in meaning and effect from the section to which such
holding shall apply.
SECTION 3.
This ordinance shall be published as provided by law and it shall
become law and take effect immediately upon its Second Reading and
Final adoption.
