RESOLUTION NO. 2012-14
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CLERMONT, LAKE COUNTY, FLORIDA, TEMPORARILY
PROVIDING THAT IMPACT FEES MAY BE PAID AT A DATE LATER
THAN THE ISSUANCE OF A BUILDING PERMIT; PROVIDING FOR
CONFLICT; EFFECTIVE DATE; AND AUTOMATIC SUNSET DATE.
WHEREAS, the City of Clermont has by ordinances established water and sewer; park
and recreation; police protection and fire protection impact fees to be collected by the City at or
upon issuance of applicable building and construction permits; and
WHEREAS, the City Council has determined that it is in the best interest of the citizens
of the City of Clermont to promote economic development and assist homebuyers, construction
companies and developers by temporarily extending the time when impact fees have to be paid;
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of
Clermont, Lake County Florida, as follows:
SECTION 1
The City Council does hereby provide that all impact fees imposed by the City of Clermont shall
be paid by the impact fee payer as a condition of and pnor'to the date of the earlier of:
1. the issuance of a Certificate of Occupancy; or
2. the acceptance and final approval by the City of any water and sewer improvements
required to connect to the City's system
SECTION 2
Any resolution previously adopted by the City Council and in conflict herewith is hereby
repealed to the extent of the conflict.
SECTION 3
This resolution shall take effect immediately upon its adoption.
SECTION 4
Unless readopted or codified by subsequent resolution or ordinance of the City Council, the
provisions adopted herein shall sunset and be of no force and effect in the City of Clermont upon
the expiration of one (1) year from the date of its adoption.
