2012-44 Task Order No. 3 To Agreement Professional Engineering Services CITY OF CLERMONT WETLAND MONITORING PROGRAM (WMP) SUPPORT This Scope of Services is Task Order No. 3 pursuant to the Professional Engineering Services Agreement dated October 13, 2009 between the City of Clermont, hereinafter referred to as "CITY," and AECOM Technical Services, Inc., hereinafter referred to as "ENGINEER ". A. Introduction This Task Order authorizes the ENGINEER to prepare a baseline wetland evaluation report, and assist the City's well contractor during the installation fof four (4) piezometric monitoring wells per Conditions #40 -47 of the Consumptive Use Permit #2478 issued by the St. Johns River Water Management District (SJRWMD) on October 11, 2011 B. Background The CITY's Wetland Monitoring Program (WMP) consists of water level data collected at five (5) locations using piezometeric (PZ) monitoring wells With automated data recording devices The CITY does not have vegetation or soil data at these locations. The five (5) sites currently monitored by the CITY are. 1. PZ -1 (ID 244015), Forested wetland in Montverde 2 PZ -2 (ID 244163), Forested wetland in Greater Hills 3 PZ -3 (ID 244164), Jack's Lake, (to be replaced) 4 PZ -5 (ID 244074), Lake Felter, (to be replaced) 5 PZ -6 (ID 244073), Unnamed Lake, corner of US 27 and 5 Mile Line Rd (to be replaced) SJRWMD RAI dated December 16, 2010 noted, "The wetland hydrographs for all of the monitonng sites do not appear to capture the entire range of fluctuation The hydrographs appear to "bottom out" for periods of time, indicating that the monitonng well depths are too shallow " AECOM field investigations of the piezometer monitoring wells and historical water levels indicated that three (3) of the five (5) monitoring wells were not deep enough to capture the full range of water levels in the water bodies being monitored Subsequently, the CITY committed in the response letter, dated June 14, 2011, to the SJRWMD RAI to abandon PZ -3, PZ -5, and PZ -6 and construct new, deeper monitoring wells at these locations Wetland Momtonng Program CUP (3- Apr - I docx A-COM • In addition, SJRWMD issued CUP #2478 to the City and per Conditions #30 -47 the CITY must ➢ Coordinate installation and survey of one (1) new piezometric well (PZ -7) at Blacks Still Lake (Sec 15, T. 22 S , R 26 E.) by October 11, 2012. ➢ Collect baseline wetland vegetation, soil, and topographic data in transects at all six (6) monitoring locations by October 11, 2012. ➢ Prepare a Wetland Baseline Monitoring Report by April 11, 2012 (Per SJRWMD the date is typo in permit should be Apn12013) ➢ Submit Annual Wetland Monitoring Reports by March 31 of each year thereafter. If the permittee is unable to obtain or maintain legal access to any of the monitoring sites referenced above, the permittee must notify SJRWMD in writing within 15 days of concluding that access to any specific site is not possible Within 45 days of this notification, the permittee must submit an alternative site to modify the monitoring network Within six months of SJRWMD approval of the monitoring network modification, the permittee must implement any approved change If another agency or utility is monitoring the same water body, then the same monitoring equipment/data can, upon written approval by SJRWMD, be used with the owner's consent A staff gauge may substitute for a shallow monitoring well, if the SJRWMD determines that the substitution would be capable of capturing a complete range of water fluctuation C. Scope of Services The purpose of this scope is to provide services to help the CITY comply with CUP Special Conditions #40-47 as detailed in the following tasks. TASK 1: Project Management 1.1 Project Status, Invoices, and Health and Safety Plan (HASP) — Subcontract survey, and wetland soil services Monitor the project schedule as it relates to the scope contained herein and provide timely invoicing and reporting of project progress This task also includes preparation of a Health and Safety Plan (HASP). 1 2 Progress Meetings - Prepare for and conduct up to two (2) progress meetings with CITY staff including a kick -off meeting to assess the appropriateness of the new piezometric well location at Blacks Still Lake identified by Condition #41 City is responsible for providing access to all sites. TASK 2: Wetland Monitoring Services 2.1 Piezometric Well and Study Transect Locations - Meet with SJRWMD staff (one (1) site visit) to obtain concurrence of the location of the proposed piezometric wells and study transects required to meet the intent of the CUP special conditions. Meet with the City and sub - consultants (one (1) site visit) to review in the field approved locations of the piezometric wells and study transects. 2 [ Wetland Monnonng Program -CUP (3 -Apr- (2) docx _ A.:COM 2 2 Piezometric Well Design Concurrence — Submit well design and construction specifications provided by the City's well contractor to SJRWMD for concurrence Assume one (1) meeting with SJRWMD staff or Lake County will be conducted to review design specifications 2 3 Piezometric Monitoring Well Documentation — Photo - document the abandonment of three (3) piezometers, and the installation of four (4) piezometric monitoring wells Each of the monitoring wells should be equipped with automated data loggers by the City's contractor Piezometric monitoring well abandonment and construction reports are to be prepared by the City's contractor. 2 4 SoilNegetation Assessment — Coordinate soil sampling and conduct a vegetative assessment for each transect established. The following data will be collected at 25 foot intervals along the 150 -foot (maximum) long study transect ➢ photo - documentation, ➢ description of plant communities with specific emphasis on changes in community types, and ➢ soil color, texture, and hydric soil indicators in the top 24 inches of soil Project wetland and soil scientist will stake in the field soil and vegetation transition points for the project surveyor to locate 2 5 Well and Transect Survey— Coordinate and observe a licensed professional surveyor to establish controlled survey locations of each piezometnc monitoring well and transect Surveyor will establish piezometric well ground and top of well casing elevations at all six (6) piezometric well sites, soil surface elevations at 5 foot intervals for each 150 -foot transect and seven (7) soil sample locations along each transect TASK 3: Wetland Baseline Monitoring Report 3.1 Wetland Baseline Monitoring Report - Prepare wetland baseline monitoring site report for CITY review summarizing the field data collected for submittal to the SJRWMD The Wetland Baseline Monitoring Report will include > Copies of all well abandonment and completion reports provided by the CITY's well contractor ➢ Photo documentation of the new and abandoned wells > Signed and sealed survey exhibits > Topographic diagrams of each study transect with the elevations from survey, plant communities, hydric soil transitions, and piezometer monitoring well elevations noted > Summary of the soils and vegetation data collected ➢ Photographs of each transect 3 2 QA/QC Review - Perform in -house QA/QC procedures of deliverables. 3 3 Finalize Reports — Submit Wetland Baseline Monitoring Report to SJRWMD 3 Wetland Mon,tonng Program-CUP (3-Apr- 1 2) docx A XO`e TASK 4: Contingency 4 1 Contingency - Contingency budget for additional services to be authorized by CITY on a time and materials basis, pending written authorization from Utilities Director. D. Subconsultants The responsibilities necessary to comply with the SJRWMD CUP conditions are listed below. b sp+ Rapid Survey, Inc Controlled Survey of Piezometric Wells and Transects Wade Hurt, Soil Scientist Transect Soil Assessment E. City's Responsibilities The following are CITY responsibilities: ➢ Access to piezometric well and study transect sites. ➢ Contract well design, abandonment and construction services ➢ Supply and install automated water level data loggers ➢ 'Review of deliverables within fourteen (14) days of draft submittals ➢ Obtain easements for piezometric wells and transects if necessary F. Services Not Included Services described herein will be provided in accordance with the current generally accepted standards of the engineering profession Certain assumptions have been made in preparing this scope of services. To the extent possible, services are stated herein and are reflected in the budget estimates included in this scope of services Reasonable material changes between work tasks, or level of effort actually required and those budgeted, may serve as a { basis for modifying this scope and budget, as mutually agreed to between CITY and ENGINEER. Requests for additional information (RAIs) from regulatory agencies will be addressed on a case by case basis. 4 Wetland Monnonng Program -CUP (3- Apr -12) docx wZCO•,�+ G. Deliverables The ENGINEER will submit the following deliverables to the CITY as DRAFT reports for review and comment and then submit a final to SRJWMD. Compensation Compensation for the Scope of Services described herein shall be paid on an aggregate lump- . sum basis for Task 1, 2 and 3 A $5,000 time and material contingency budget is established for Task 4 to be expended only upon written authorization from the Director of Engineering pending results of constraints identified during site visit. Details of the proposed compensation are presented in Attachment A. Progress payments shall be due and payable monthly based on invoices submitted by the ENGINEER. Task 1 Project Management $ 8,700 Task 2 Wetland Monitoring Services $26,820 Task 3 Wetland Baseline Monitoring Report $11,480 Task 4 Contingencies (Time and Material) $ 5,000 Total $52,000 I. Schedule Services pursuant to this Scope of Services will commence upon ENGINEER's receipt of Notice To Proceed (NTP) from the CITY Study transect locations and water level monitoring must be initiated and approved by SJRWMD staff by 10/11/2012 In practice, the piezometric wells are to be located within study transects, so the study transect approvals must take place concurrently with piezometric well location approvals The wetland baseline monitoring report must be submitted to the SJRWMD on or before 4/11/2013 The ENGINEER will observe the time limitations, however, should there be delays in receiving information from others and in obtaining subsequent authorization, approvals, and review. comments from the CITY, and other governmental agencies, the schedule will be updated and 5 Wetland Monitor ng Program -CUP (3 -Apr- 12) docx A_COM adjusted as mutually agreed upon by the ENGINEER and the CITY. The ENGINEER shall not be responsible for delays that occur as the result of action or inaction of CITY or others. J. Additional Provisions ENGINEER is entitled to rely upon the accuracy of historical and existing data and information provided by CITY and others without independent review and verification ENGINEER is not responsible for the means, methods, sequences, techniques or procedures of CITY and Contractor operations or for safety precautions and programs. Documents, drawings, specifications, and electronic information /data, including computer aided drafting and design (CADD), prepared by ENGINEER pursuant to this agreement are not intended or represented to be suitable for reuse by CITY or others on extensions of the Project or on any other project. Any use of completed documents for other projects and any use of incomplete documents without specific written authorization from ENGINEER will beat CITY's sole risk and without liability to ENGINEER. CITY assumes full responsibility for , such changes unless CITY has given ENGINEER prior notice and has received from ENGINEER written consent for such changes. Electronic data delivered to CITY is for CITY's convenience and shall not include the professional stamp or signature of an engineer or architect. CITY agrees that ENGINEER shall not be liable for claims, liabilities or losses arising out of, or connected with the decline of accuracy or readability of electronic data to inappropriate storage conditions or duration K. Authorization This Task Order serves as an Exhibit to the Professional Engineering Services Agreement dated October 13, 2009 between the CITY and ENGINEER, and is hereby incorporated into this Task Order by reference.
