AN ORDINANCE AOOPTING THE NATIONAL ELECTRIC OODE
AND PROVISIONS FOR EXAMINATION OF APPLICANTS FOR
LICENSES AS ELECTRICIANS AND FOR A BOARD OF EXAMINERS
AND AN ELECTRICAL INSPECTOR, AND DETAILING THE METHOD
FOR SELECTION OF SAID BOARD OF EXAMINERS AND ELECTRI-
CAL INSPECTOR AND DEFINING THEIR DUTIES; REGULATING
THE SUPPLY OF ELECTRIC CURRENT TO NEW INSTALLATIONS,
AND PROVIDING FOR REVOCATION OF LICENSE OF ELECTRI-
CANS UPON NAMED OONDITIONS, AND REQUIRING ELECTRICAL
WORK PERMITS, AND OTHER MATTERS RELATING THERETO.
BE IT ORDAINED AND ESTABLISHED BY THE CITY OOUNCIL OF THE CITY OF
CLERMONT, FLORIDA:
SECTION 1. The necessity in the public interest for the
provisions and prohibitions hereinafter contained and enacted is
declared as a matter of legislative determination and public policy,
and it is further declared that the provisions and prohibitions
hereinafter contained and enacted are within the Police Powers
of the City of Clermont and are for the purpose of securing and
PTOmoting the public health, comfort, convenience, safety and genu.ral
welfare of the City of Clermont and its inhabitants.
SECTION 2. The NATIONAL ELECTRIC OODE is hereby adopted
and approved, and made a part of this ordinance, and shall henceforth
be the minimum standard of practice of licensed electricians in the
City of Clermont, Lake County, Florida, this Code, together with all
amendments or restrictions thereto as shall hereafter be adopted by
the City Council of the City of Clermont shall henceforth be given
full force and effect as the law in this municipality.
The National Electric Code is hereby amended to
include each of the following the same as if originally included
therein:
(a) Conductors, whether solid or stranded shall
not be smaller than Number 12, except for control circuits
or switch loops for lighting circuits.
(b) Fuse or circuit breaker panels shall not be
installed in cabinets or any other place not readily
accessible for operation or repair.
(c) The use of "BX" type armored cable is prohibited.
(d) The minimum size conductor to serve electric
ranges shall be Number 6, .except the neutral may be Number
8. Ranges, other than built-in models such as "Thermidore",
"Hendi-Cook" and others of like design, shall be provided with
receptacle and range cord. Range cord shall meet the same
size restriction as circuit wiring.

(e) The fOllowing shall control the installation of
all grounds:
(1) Ground wires on all buildings shall be
connected at the meter base and the other end shall be
attached to the City's water system, if within 50 feet
thereof, but being unable to so connect the ground a
3/4" galvanized pipe shall be driven into the ground
10 feet and the ground connected thereto.
(2) Ground wires myst be attached to pipes with
standard underwriter approved ground clamp.
(3) Ground wire shall consist of No. 4 soft bare,
solid copper wire or its manufactured equivalent.

(f) The most recent edition of the Florida Power
Corporation I s book or pamphlet covering "Requirements for
Electric Service and Meter Installations" shall be adopted
as a part of this ordinance and shall be and hereby is
declared to be the minimum requirements in all matters
covered therein.
SECTION 3. Hereafter, all persons, firms or corporations
making application to the City of Clermont or to any of its duly
authorized officers for a license to engage in the occupation of
electrician shall be required before the issuance of such license,
to take a written examination based upon the National Electric Code,
and pass same with a minimum establi shed by the Examining Board
and in effect at time of examination.
In order to provide ample opportunity for electricians
licensed by the City of Clermont on the date of the passage of this
ordinance to comply with the provisions of this ordinance, such
electricians shall be allowed until September 30, 1955 at 5 ~'clock P.M.
to comply with these examination requirements. New applicants shall
be required to take and pass said examination.
SECTION 4.
govern the membership,
or Examining Board:
The following provisions herein shall strictly
powers and duties of the Board of Examiners
(a) The Board composing three (3) members shall be:
President of City Council of City of Clermont;
Manager of a firm or corporation furnishing electrical
power within the City of Clermont; and a
Third member appointed by the other members.
(b) The first Board of Examiners shall be selected
by the City Council within ten (10) days from the passage and
adoption of this ordinance, which Board shall serve until the first
Regular Meeting of the City Council in January of 1956. Thereafter
the membership of the Board shall be appointed, as provided in this
section, to serve until the first Regular Meeting of the City Council
in the following January of each year after 1956. Vacancy on the
Board shall be filled within ten (10) days às provided herein for the
selection of the membership of the Board.
(c) No person licensed as an electrician under this
ordinance, or in any way connected with any person, firm or corporation
engaged in the occupation of electrician or electrical contractors
or engaged in the sale at retail or wholesale of any electrical
wiring, supplies or appliances shall be eligible to serve as a member
of this Board. In the event the President of the City Council of
the City of Clermont is so engaged or so connected or interested as
herein provided then the Council shall select one of their membership
to serve as a member of the Board. In the event a manager of a
Power Company cannot, for any reason, so serve the City Council shall
select another of their choice so qualified to serve.

(d) Within ten (10) days after their selection or
appointment the Board shall meet in the City Hall of the City of
Clermont and shall select one of their number as Chairman. The
City Clerk of the City of Clermont shall at all times serve as
Secretary to the Board whose duty shall be to keep all minutes of
each Board Meeting and perform such other duties as directed by
the Board.

The Board shall serve without compensation. The City
Council of the City of Clermont, in its, discretion, may compensate
the Clerk for work performed in this capacity as Secretary of this
Board. All expenses of the Board in the performance of its duties
hereunder shall be approved by the City Council before being incurred,
and then shall be paid out of the General Fund of the City of Clermont.
SECTION 5. The following shall strictly govern all
examinations of the Board:
(a) The Board shall, for the information of those
desiring same, make and provide for distribution all rules, regulations
and amendments thereof pertaining to examinations to be conducted
under this ordinance. They shall provide application blanks for
distribution by the City Clerk of the City of Clermont to those
applying for an occupational license as electrician in the City of
Clermont under its ordinance governing and regulating the issuance
of occupational license as electrician in the City of Clermont.
(b) Upon the City Clerk receiving application for
license as electrician under this ordinance, he shall notify in
writing the Chairman of the Board, and the Board will cause the
applicant to be examined in writing wi thin ten (10) days from the
date of his application, unless two or more should so apply within
any ten (10) day period, in which event, the Board shall set a date
for examination, to be held within fifteen (15) days from the date
of the first application.
(c) All examination questions shall be typed or
printed and each applicant shall furnish his own writing material
upon which to write the examination in accordance with the regulations
of the Board, unless so provided by the Hoard. No examination fee
shall be charged. All examinations shall be conducted in the city
Hall of said City before the City Clerk, or his appointee.
(d) Each applicant's examination shall be preserved
by the Board as long as the applicant is licensed under this
ordinance.
(e) Each applicant passing shall receive within five
(5) days his license to engage in the occupation as an electrician in
the City of Clermont. Those failing shall be so notified and shall
be eilti tled to be re-examined wi thin five (5) days. Any person
failing three (3) consecutive examinations shall not be entitled
to a re-examination within six (6) months of the last examination.
All applicants are entitled to examine their examination paper after
graded by the Board (each examination shall be signed by all members
of the Board). Any applicant not qualifying for a license under the
examination, the applicant may notify the City Council in writing and
upon receipt of same said Council shall cause the examination paper,
at least two (2) Board Members and the applicant to appear before
them when the applicant and the Board shall be fully heard. The
applicant may have his attorney attend this meeting.

If the Council shall concur in the grading by
the Board, or the up-grading by the Board shall not qualify the
applicant to license under this ordinance the applicant shall be
entitled to re-examination within five (5) days as herein provided.
(f) Each applicant and licensed electrician shall
obtain his own copy of the National Electric Code in force and effect
at time of his examination and thereafter when same is amended or
another code other than the presen~ code is adopted and printed
he shall obtain a copy and present same to the City Clerk and/or
Secretary of the Board for his endorsement. Failure to obtain same
shall disqualify an applicant for examination under the ordinance.

Failure of a licensed electrician to obtain an amended or subsequent
compiled National Electric Code, when so notified by the Board to
obtain same, shall not entitle the electrician to be re-licensed
by the City of Clermont until same is obtained which must be so
obtained wi thin thirty (30) days of notice. If not then so obtained
the electrician must then be re-examined in order to qualify for a
license under this. ordinance.
(g) If an electrician, formerly licensed under this
ordinance shall allow one (1) year to lapse without being licensed
under the Occupational License ordinance of this City then he shall
be required to take an examination as if he were originally applying
for a license.
SECTION 6. An Electrical Inspector shall be appointed
by the City Council within ten (10) days from the passage and
adoption of the ordinance and thereafter at the first Regular
Meeting of the City Council in January in each year hereafter.
His compensation and/or fees shall be set by the City Council but
same shall only be based on required inspections by him made under
this ordinance, and shall be paid, if required, at the time of the
issuance of the permit hereinafter required and provided for.
The duties of the Electrical Inspector shall be to
make such inspections as may be necessary to determine that henceforth
all work done and materials used in electrical wiring shall conform
in every respect with the National Electric Code; to approve or
disapprove, in writing, such work and materials, and to specify his
reasons for disapproval when any disapproval is made; to warn
electricians, as well as the contractor, owners or agents of the owner
of minor violations of or departures from the National Electric Code,
and to report all such warnings to the City Council of the City of
Clermont; to direct licensed electricians to correct important, major
or dangerous violations or departures of or from said code, and to
report all such directions to the said Council and also to report
to said Council all refusals or failures to obey such directions, and
copy thereof to go to the contractor, owners or agents of the owner
of the property. On new construction or remodeling there shall be
at least two inspections made. One while the rough construction and
wiring is still exposed, and the other upon completion of the work.
The inspection will be made within the next succeeding four working
hours from the time requested. It shall be unlawful for contractor
to allow wiring to be concealed before it has been passed by the
inspector.
SECTION 7. The installation requirements for Electric
Service and Meter Installations shall conform to the requirements
. of the person, firm or corporation furnishing power from its trans-
mission lines. For the present minimum requirements these established
and in force by the local power company (Florida Power Corporation)
are hereby established as the minimum requirements, under this
ordinance.
The installation of temporary service to any building
or upon any property wi thin the City of Clermont for construction
purposes or for any other pu.rpose shall be installed in accordance
with the minimum requirements of Electric Service and Meter Installation
of the Florida Power Corporati?n as established and adopted herein.

It shall be unlawful for any person, firm or
corporation to supply electrical power to any property or building
or to any electrical installation hereafter installed until such
electrical installation shall be first approved by the Electrical
Inspector.
SECTION 8. Prior to entering upon any new electrical work
of the type or types contemplated by the National Electrical Code
each licensed electrician in the City of Clermont or other electrician

or individual performing such work in the City of Clermont shall
obtain a permit from the City of Clermont for each job. Failure
to obtain this permit shall result in disapproval of the work by
the Electrical Inspector. This provision shall also apply to temporary
service for construction or other purposes.
The ·following inspection fees shall accompany a
permit application and paid to Clerk of City of Clermont:

SECTION 9. Nothing herein contained shall be construed
in any way as restraining or preventing any person, firm or corporation
from performing its own electrical work and using its own materials
on any property owned by said person, firm or corporation, without
a license; provided, however such work done and materials used must
conform with the National Electric Code and be approved by the
Electric~ Inspector, as though done by a licensed electrician.
SECTION 10. In the event the Electrical Inspector
shall three (3) times warn a licensed electrician of violations
or departures of or from the National Electric Code, as amended,
and said licensed electrician thereafter repeats the same violations
or departures or any of them, the license of+~iQ..¡J.icensed electrician
may, for that cause, be revoked in the mar1h~r/\If'ihis ordinance.
In the event the Electrical Inspector shall direct a
licensed electrician to correct a violation or departure of or
·from the National Electric Code, and said licensed electrician shall re-
fuse to obey such direction or shall fail, within a reasonable time,
to comply with such direction, the license of said licensed electrician
may, for that cause, be revoked in the manner set forth in this ordinance.
SECTION 11. Revocation of the license of any licensed
electrician shall be by the City Council of the City of Clermont,
for any cause enumerated in this ordinance.' Before the said City
Council shall revoke any such license, it shall give the licensee
a written statement of the cause for revocation of the license,
and a full hearing, if the licensee shall demand a hearing within
fifteen (15) days after receiving said notice or statement, such
demand of hearing to be made in writing. At such hearing, the
licensee shall be entitled to produce witnesses and be represented
by counsel. The reasonableness of the warnings or directions of the
Electrical Inspector shall be considered. In order to permit a
licensee whose license shall be revoked an opportunity to apply
to the Courts for relief, no revocation of license by the City
Council shall become· effective until ten (10) days after such re-
vocation, but shall then become fully effective unless prevented
by judicial action. If the licensee does not demand a hearing after
receiving the written statement of cause for revocation, as
herein provided, the license shall be revoked.

SECTION 12. Any reference to the National Electric Code
the 1953 Code is referred to including all amendments thereto.
Hereafter any re-compiled or re-published National Electric Code
is hereby approved and made a part of this ordinance and thereafter
shall be the minimum standard of practice of licensed electricians
in the City of Clermont the same as if same had been adopted hereby.
The Board or the City Council may keep a supply of
said codes for applicants or licensed electricians which shall be
resold at cost to those desiring same.
SECTION 13. All electricians now licensed by the City of
Clermont, as well as those hereafter making application shall be
furnished with a. copy of this ordinance.

SECTION 14. All members of a firm performing the work
of an electrician shall first obtain a license under this ordinance.
Any corporation having electricians in its employ
shall have each licensed ·mjder this ordinance.
Nothing herein shall prevent any licensed person,
firm or corporation from having assistants, journey-men electricians
or apprenticed electricians in their employ who shall not be required
to be licensed under this ordinance, unless otherwise required
by an ordinance or ordinances of the City of Clermont, in which case
they shall be notified of same.
SECTION 15. This ordinance shall take effect immediately
upon its passage. Each of the provisions of this ordinance are'
severable, and if any provision shall be declared to be invalid,
the remaining provisions shall not be affected but shall remain
in full force and effect.
SECTION 16. All ordinances or parts of ordinances in
conflict with this ordinance are hereby repealed.
