CREATING PARKING METER ZONES ON CERTAIN STREETS OR HIGHVIAYS IN THE CITY OF CLEmiONT, LAKE COUNTY, FLORIDA; PROVIDING FOR THE INSTALLATION, OPERA~ TION, MAINTENN~CE, SUPERVISION AND CONTROL OF PARKING METERS IN SUCH ZONES, REGULATING ~ RESTRICTING THE PARKING OF VEHICLES IN ESTABLISH- ED PARKING METER ZONES; ASSIGNING CERTAIN AUTHORI- TIES AND DUTIES IN CONNECTION \IITH THE REGULATION OF SAID TRAFFIC; PROVIDING FOR THE USE OF SAID MONIES FOR CAPITAL I~WROVE~ENTS; PROVIDING PENALTIES FOR THE VIOLATION OF ~ OF THE PROVISIONS HEREOF AND REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES IN SO FAR AS THEY ARE INCONSISTENT HEREV~TH. . BE IT ORDAINED AND ESTABLISHED BY THE COUNCIL OF THE CITY OF CLERMONT, LN(E COUNTY, FLORIDA: SECTION 1: This ordinance shall be known and may be cited as liThe Parking Meter Ordinance ". SECTION 2: The terms used in this ordinance shall have the following meanings ascribed to them: a. Parking Meter Zones shall mean streets or highways or portions thereof, on which parking meters are installed, operated and used. b. "Parking Meters" shall mean a mechanical device intended to assist public authori- ties in enforcing the provisions of this ordinance, limiting the time during which vehicles may be parked on any street or hfughway within tGe Parking Meter Zone. c. "Vehicle" shall mean any conveyance of any character for the transportation of persons or property. SECTION 3: Parking Meter Zones are hereby established in the following areas: ON MONTROSE, SEVENTH (7th) AND EIGHTH (8th) STREETS IN THE CITY OF CLERMONT. SECTION 4: Parking in any Parking Meter Zone on Wednesday, after 12:00 Noon, Sundays and legal holidays is hereby specifically excluded from the provisions of this ordinance. SECTION 5: On all days, other than those mentioned in Section 4 hereof, parking is hereby limited to a period of time not in excess of four (4) hours and between the hours of 8:00 A.M. and 6:00 P.M. . SECTION 6: In all parking meter zones, a parking meter shall be installed for each parking space. All parking spaces shall be plainly marked by lines on the street. SECTION 7: Parking meters shall be placed upon the sidewalk or curb immediately adjacent or next to each designated' parking space and in such manner as to show or display by a ""'1""""""," /,\ ~ .. Signal that the parking space controlled by such meter, i1i or is not legally occupied. FUrther, each parking meter shall indicate by a proper legend the established rate and the legal parking time, and, when in operation, shall also indicate on or by its dial or pointer the duration of the period of legal parking and any illegal or overparking. SECTION 8: Any vehicle parked in any Parking Meter Zone at any time during which the provisions of this ordin- ance are in effect shall be entirely within the lines of the desiginated parking space and adjacent to the parking meter controlling such parking space. SECTION 9: Upon parking any vehicle in a Parking Meter Zone at any time during which the provisions of this Ordinance are in effect, the operator of the parked vehicle shall deposit, or cause to be deposited immediately after parking, a one cent coin; two one-cent coin1i; three one-cent coins; four one-cent co~ns; five one-cent coins; or a five-cent coin, and, in like manner, up to ten one-cent coins or two two five-cent coins of the United States of America in the parking meter controlling such parking space and failure to do so, shall constitute a violation of this ordinance. The deposit of each one-cent coin shall entitle the vehicle to occupy said space for a period not to exceed twelve minutes immediately following such deposit and an additional twelve minutes for each additional one-cent coin so deposited, not however, to exceed ten such coins; the deposit of a five-cent coin shall entitle the vehicle to occupy said space for a period not to exceed one hour immediately following such deposit, and the deposit of two five-cent coins shall entitle the vehicle to occupy said space for a period not to exceed two hours immediately following such deposit; the City Council, however, may limit parking time in desiginated zones, provided such time limits are plainly marked on the meters in such limited zones. SECTION 10: The coins hereby required to be deposited are levied and assessed as fees to provide fDD the proper regu- lation and control of such traffic upo¡ L the highways, including the cost of supervision and regulation of the parking ~~r.e~s ~ of vehicles in the parking meter zones herein created and the cost of the purchases, surpervision, inspection, installation, operation, maintenance, control and use of the aforesaid parking meters. The coins to be deposited shall be collected and accounted for, under the supervision of the Finance Committee of Council, and deposited in General or Special account, to be determined by the City Council. Balance of all moneys derived under this Section and ordinance are hereby pledged and shall only be used by the City Council of the City of Clermont for the Capital Improvements, including any Capital improvements in connection with any recreational facility, within the City of Clermont, except any mones required for the payment of control, oper- ation and maintenance of said meters, which may, in the discretion of the City Council, include salary of at least one police officer. SECTION 11: No owner or operator of any vehicle shall cause, allow, permit or suffer such vehicle to be parked over- time or beyond the period of the legal parking time established and set forth in section 9; nor may he cause, allow, permit or suffer such vehicle to be parked in tI.hJ!i manner contrary to the manner prescribed by this ordinance. SECTION 12: No person shall deposit, or cause to be -2- . deposited in any parking meter any slug devise, foreign sub- stance or substitute for a coin of the United States. SECTION 13: No person shall deface, injure, tamper with, or willfully break, destroy or impair the usefulness of any parking meter. SECTION 14: Nothing in this ordinance shall be construed as prohibiting the City Council of the City of Clermont or the Police Department with the approval of the City Council from providing for free parking space for un- loading and loading commercial vehicles, for bus stops, for ,taxicab stands, or for other matters of a similar nature. SECTION l5: The duties of enforcing the provisions of this ordinance shall be upon the Mayor or the City Council of the City of Clermont, acting through the Police Department. SECTION 16: It shall be the duty of the police officers of the City of Clermont, acting in accordance with instructions issued by the Mayor or City Council, to deposit with the City Clerk, the stub of every vXlation ticket, such stub shall contain: a. The number of the parking meter adjacent to the vehicle which was parked in viola- tion of this ordinance. b. The State license number of such vehicle. c. The day and hour at which such vehicle is parked in violation of this ordinance. d. Any other facts which the officer deems necessary to properly understand the circumstances of the violation. . r Every such police officer shall also place on such vehicle a notice to the owner thereof that such vehicle has been parked in violation of the provisions of this ordin- ance and instructing such owner to report to the office of the City Clerk, or such authority as the City Council may other- wise designate, in regard to such violation. Each such owner, may, within forty-eight hours after such violation, pay to the City Clerk, or such other authority as the City Council may designate, the sum of twenty-five cents ($0.25) for, and in full satisfaction of such violation. The failure of such owner to make such payment within said forty-eight hours, shall render such owner subject to the penalties hereinafter provided for violating the provisions of this ordinance. The City Clerk, or such authority as the City Council may otherwise designate, shall report all penalties received by him and pay over said penalties received by him as now provided by law for the account- ing and payment of moneys received by him. However, it shall not be necessary for the violator to go before the City Clerk, or other designated per- son if he or she will use the IIfine boxes" located at various places in the metered zones on the meter posts. SECTION l7: Otherwise than as herein modified, or changed, all existing parking regulations of the City ·of Clermont shall be and remain in full force and effect. SECTION 18: Any person, firm or corporation whether -3- . principal or agent violating any provisions of this ordinance sgall, upon convition thereof, be sentenced to pay a fine not exceeding Twenty Five Dollars ($25.00) and costs of prosecution, and in default of the payment of such fine and costs of 1rosecution shall be fine not more than Twenty Five Dgllars 25.00) or be imprisoned in the city Jail not more th!n one ay, or by both such fine and imprisionment, in the discretion of the Judge of the Municipal Court of the City of Clermont. SECTION 19: If any provisions of this ordinance for any reason shall be declared invailid by the courts having jurisdiction thereof, the intention of this ordinance is hereby expressed that all other provisions shall, neverthe- less be sustained and enforced. SECTION 20: All ordinance s or part s of ordinance s in so far as the same are inconsistent herewith, be, and the smroe are, hereby repealed. ------------------------------------------------------------- PASSED AND ADOPTED by the City Council of the Clermont, Lake County, Florida, at its adjourned meeting held in the city hall in the City of Clermont on September 1, 1955.
