ORDINANCE NO.150
AN ORDINANCE ABOLISHING, VACATING AND FOREVER CLOSING FRAC-
TIONAL PART OF DE SOTO STREET LYING WEST OF Tl'/ELFTH STREET,
AS REPRESENTED ON THE OFFICIAL MAP OF THE CITY OF CLERMONT,
FILED 2/4/26 AND RECORDED IN PLAT BOOK 8, PAGES 17_23, IN-
CLUSIVE, PUBLIC RECORDS OF LAKE COUNTY, FLORIDA; PROVIDING
FOR 1HE REVERTING AND/OR CONVEYANCE OF SAID STREET· TO THE
OWNER, OR OWNERS, OF THE PROPERTY ABUTTING THERETO.
WHEREAS, fractional part of De Soto Street 1ying West of
Twelfth Street, as represented on ihe Official Map of the City of
Clermont, filed 2/4/26 and recorded in Plat Book 8, Pages 17-23, inclu-
sive, Public Records of Lake County, Florida, has (a) never been opened
to, or used by, the traveling public, (b) never been used by the abutt_
ing property owners as a street, path, driveway or passageway, (c) has
been set into citrus trees now over twenty-one (21) years of age; and,
the records of the City do not disclose a request for the opening, im-
proving and maintenance of said street; and, the former and present owners
of ihe abutting property have requested that said part of De Soto Street
be forever closed; and, therefore, it is to the best interests and gen_
eral welfare of the City of Clermont that said fractional part of said
De Soto Street be abolished, abandoned, closed and vacated, and said
street revert to and become the property of the abutting property owners,
and, the owner of the fee title to the property abutting said street is,
JOSEPH p. HURLEY, as Bishop of the Diocese of St. Augustine, and his successors
in office and assigns forever,
and,
WHEREAS, Notice of the City Council's intention to con-
sider passage of an Ordinance to forever abandon, abolish, close and
vacate said fractional part of De Soto Street as described hereinabove
by publishing said Notice in ihe Clermont Press, a newspaper of general
circulation published in Clermont, Florida (newspaper copy ihereof and
proof of publication thereof being attached hereto and made a part here_
of) in the weekly issues of October 19th, 26th and November 1st and 8th,
1956; and, the Ci1;y Clerk and Council of ihe City of Clermont having re_
ceived no objections, written or oral, to the passage of this Ordinance;
therefore,
BE IT ORDAINED AND ESTABLISHED BY THE CITY COUæIL OF THE CITY OF CLERMONT,
LAKE COUNTY, FLORIDA:
SECTION I: That fractional part of De Soto Street 1ying
West of Twelfth Street, as represented on the Official Map of the City
of Clermont, filed 2/4/26 and recorded in Plat Book 8, Pages 17_23, in_
clusive, Public Records of Lake County, Florida, be and the same is here_
by forever abolished, abandoned, vacated and closed as a street, thorough-
fare or public-way by the City of Clermont; and, same is hereby forever
closed to the general public under the authority of the Charter of ihe Ci1;y
of Clermont and under Chapter 167.01 Florida Statutes of 1955.

SECTION II: The Mayor and the City Clerk of the City of
Clermont are hereby directed to cause to be prepared and executed by the
Mayor and the City Clerk of the City of Clermont Deed or Deeds of Conveyance
conveying any and all right, title or interest in and to that fractional
part of De Sota Street 1ying West of Twelfth Street, as represented on the
Official Map of the City of Clermont, filed 2/4/26 and recorded in Plat
Book 8, Pages 17-23, inclusive, Public Records of Lake County, Florida, the
same being hereby äbandoned, vacated and forever closed to the general

public, to the owners of record of the fee simple title to the abutt-
ing property on or after the passage and adoption of this Ordinance
by ihe Ci1;y Council of the City of Clermont, and the approval of same
by ihe Mayor of the City of Clermont.
SECTION III: This Ordinance shall take effect im-
mediate1y upon its adoption, passage and approval.

Clermont at a regular meeting held on November 6, 1956 in the City of
Clermont, Florida.
