ORDINANCE NO. 20
AN ORDINANCE PIDHIBITmG mE OPERATION
OF MOWR VEHICLES BY ANY PERSON OR PER-
SONS UNDER THE INFLUENCE OF IN'roXICAT-
ING LIQUORS.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CLERMONT:

Seotion 1. That from end after the passage of this
ordinance, it shall be unlawful tor any person to operate,
upon any street, avenue, or highway, wi thin the corpo~a te
11m! ta of the C1 ty o~ Clermont, any motor vehicle. while
the driver is under the influence of intoxioating l~quor.
Section 2. For the purposes of this ordinance, the
person driving the motor vehicle shall be deemed to be the
person responsible for the operation of same, . and for the
purpose of this ordinance the question of whether or not
the driver is under the influence of intoxicating liquor
shall be a question of fact to be determined by the evi-
dence. It is not the purpose öï this ordinance to re-
quire proof that such driver shall be in an intoxicated
condition, but proof that such driver is under the in-
fluence of intoxicating liquor to the extent that the
motor vehicle is being operated to the jeopardy of other
vehicles or of pedestrians shall be sufficient.
Section 3. Any person convicted of the violation
of this ordinance shall be punished by a fine of not
less than $10,00, nor more than $100.00, or by 1mprison-

ment in the City .Jail for not less than one day nor more
than '.siXb,. days, or by 'both fine and imprlsoIµnent in
the discretion of the mayor.
Section 4. All ordinances and parts of ordinances
in confliot herewith are hereby repealed so far as such
