AN ACT RELATING TO TRAFFIC AND REGU~TING USE OF PUBLIC STREETS IN TFE CITY OF CLERMONT; LAKE COUNTY, FLORIDA; DEFINING AND ESTABLISH- ING PARKING METER ZONES AND REGUL.I;TING AND CONTROLLING AND PROVIDING FOR INSPECTION OF TEE TIME PARKING OF VEHICLES THEREIN BY THE USE OF PARKING METERS; PRESCRIBING LIMITS OF THE TIME FOR PARKING IN PARKING METER ZONES; AND PROVIDING FOR THE ENFORCEMENT OF THIS ORDINANCE AND PUNISHMENT FOR ITS VIOLATION. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CLERMONT: SECTION 1. DEFINITIONS: Whenever,in this Ordinance the following terms are used, they shall have the meanings respect- ively ascribed to them in this Section. STREET: Every way set apart for public trav~l except alley- ways, bridle paths and foot þaths. ROADWAY: That portion of a street between the regularly established curb lines. SIDEWALK: That portion of a syreet between the curb lines and the adjacent property lines. VEHICLE: A conveyance propelled by motor power. PARKING METER ZONES: PARKING METER ZONES shall mean por- tions of streets described and established by the City Council as zones wherein the parking of vehicles shall be controlled, regulated, and inspected with the aid of timing devices or meters, herein referred to as parking meter or meters. SECTION 2. The following portions of streets are hereby established as parking meter zones: All of that portion of 8th Street extending from the Northern boundary of DeBot'B". Street to the Southern boundary of Minneola Avenue; All that portion of *ontrose Street extending from the Eastern boundary of est Avenue to the Eastern boundary of S~vè'ntJb. 8trl'rat; All that portion of 7th Street extending from DeSoto Street to the Southern boundary of Minneola Avenue, providing, however, that om that portion of Seventh Street lying North of the Northern boundary of Montrose Street to Minneola Avenue parking shall be allowed only on the West side of the street and shall be parallel; and providing further that on the North side of Montrose Street from the Eastern boundary of 8th Street to the Western boundary of 7th Street parking shall be parallel; and on all other streets designated herein parking shall be glagonal. . SECTION 3. The Mayor and Police Officers of the City of Clermont are hereby authorized and directed to install meters in all parking meter zones hereby established or here- after established by the City Council for the purpose of and in such numbers and at such places as in the judgment of the Mayor may be necessary to the regulation, control and inspection of the parking of vehicles therein, including the reservation of loading zones for commercial vehicles. SECTION 4. Parking meters installed in parking meter zones shall be installed upon the curb immediately adjacent to the individual parking spaces as laid out and marked by the direction of the Mayor and each parking meter shall be so con- structed and adjusted as to show when properly operated a signal that the space adjacent to which it is installed is or is not legally in use. SECTION 5. The Mayor shall have lines or markings painted upon the curbs or street adjacent to each parking meter, desig- nating the parking space for which said meter is to be used, and each vehicle parked adjacent to any parking meter shall park within said lines or markings. It shall be unlawful to park any vehicle across any such line or marking, or to park a vehicle in such a position that it shall not be entirely within the space designated by such lines or markings. SECTION 6. It shall be unlawful for any person to cause, allow, permit, or suffer any vehicle registered in his name or operated or controlled by him to be upon any street within a parking meter zone in any space adjacent to which a parking meter is installed, for more than 120 consecutive minutes, or any time during which the meter is showing a signal indicating that such space is illegally in use - other than such time as is necessary to operate the meter to show legal parking - between the hours of 8:00 o'clock A. M; and 6:00 o'clock P. M. on any day, Sundays and legal holidays excepted. . . SECTION 7. Parking meters when installed and properly operated shall be so adjusted as to show legal parking during a period of twelve minutes upon and after the deposit therein of a United States one cent coin, twenty-four minutes upon and after the deposlt therein of two United States one cent coins, thirty-six minutes upon and after the deposit therein of three Unites States one cent coins, forty-eight minutes upon and after the deposit therein of four United States one cent coins, sixty minutes upon and after the deposit therein of five United States . one cent coins or one United States five cent coin, seventy-two minutes upon and after the deposit therein of six United States one òent coins or one United States five cent coin and one United states one cent coin, eighty-four minutes upon and after the deposit therein of seven United States one cent coins or one United States five cent coin and two United States one cent coins, ninety-six minutes upon and after the deposit therein of eight United states one cent coins or one United States five cent coin and three United States one cent coins, one hundred eight minutes upon and after the deposit therein of nine United States one cent coins or one United States five cent coin and four United States one cent coins, and one hundred twenty minutes upon and after the deposit therein of ten United States one cent coins or one United States five cent coin and five United States one cent coins or two United States five cent coins. Payments of the aforesaid amounts for th,e above periods shall be made for parklng in the areas set forth hereinabove. SECTION 8. It shall be unlawful to deposit or cause to be deposited in any parking meter any slug, device, or metallic substitute for a one cent or a five cent coin of the United States. SECTION.9. It shall be unlawful for any unatthorized person to open, or for any person to deface, injure, tamper with, or wilfully break, destroy, or impair the usefulness of any parking meter installed pursuant to,this Ordinance, or to hitch any anumals thereto. SECTION 10. It shall be the duty of the Chief of police, under the direction of the Mayor, to keep account of . . all violations of this Ordinance. (a) He shall keep an account of and report the number of each parking meter which indicates that the vehiole occupying the parking space adjacent to suoh parking meter is or has been parked in violation of any provisions of this Ordinance, and date and hour of sùch violation, the make and the State license number of such vehicle, and any other facts, a knowledge of which is necessary to a thorough understanding of the circum- stances attending such violation. (b) He shall attach ' to such vehicle a notice stating that it has been parked in violation of this Ordinance, and instructing the owner or operator to report to the Polioe Department in re- gard to such violation. The owner pr operator may, within twenty- four hours after the time when such notice was attached to such vehicle, pay to the Chief of Police, in full satisfaction of such violation, the sum of One Dollar ($1.00). SECTION ll. Any person violating any provision of this ordinance shall be deemed guilty of a misdemeanor, and upon conviction thereof shall be punishable by a fine not exceeding One Hundred Dollars ($100.00), or by imprisonment in the City Jail for a period not exceeding one (1) month, or by both such fine and imprisonment. The provisions in this paragraph are subject to the provisions of Section 10 (b) of this Ordinance. SECTION 12. The amount of the coins required to be de- posited in parking meters as provided herein is hereby levied and assessed as a fee to provide for the proper regulation, control, and inspection of traffic upon the public streets, and to cover the cost of supervising, regulating, and inspecting the parking of vehicles in the parking meter zones provided for herein, the cost of placing and maintaining lines or markings designating parking spaces in parking meter zones, and the cost of the purchase, supervision, protection, inspection, lnstalla- tion, operation, maintenance, control, and use of the parking meters installed hereunder. SECTION 13. It shall be the duty of the ~tty Council to designate some person or persons to make regular collections of . the money deposited in said parking meters, and delivering the money to the City Treasurer, and it shall also be the duty of the City Treasurer to count the money and place it in a special fund to be known as the "Parking Meter Fund", which fund shall be used for the purpo~es specified in Section 12. Such person or persons making such collections shall be bonded in the sum of One Thousand Dollars to insure the faithful performance of his or their duties. SECTION 14. This Ordinance shall be deemed to be in . addition and supplementary to, and not in conflict with, nor a repeal of existing Ordinances of this City, but shall be an additional provision for the regulation of traffic and parking in the parking meter zones provided for herein. SECTION 15. If any Section, part of Section, sentence, clause or phrase of this Ordinance shall be held to be uncon- stitutional or invalid, the remaining provisions hereof shall nevertheless remain in full force and effect. SECTION 16. All Ordinances or parts of Ordinances or Resolutions in conflict with the provisions of this Ordinances are hereby repealed. SECTION 17.
