ORDINANCE NO. 87
AN ORDINANCE PREVENTING THE LICENSING OR PERMITTING
OF ANY CONCESSION OR BUSINESS IN A TENT, PORTABLE BUILD-
ING, TRUCK, TRAILER OR IN ANY OTHER STRUCTURE WITHIN THE
FIRE LIMITS OF THE CITY OF CLERMONT, OTHER THAN THOSE
STRUCTURES PERI~TTED IN THE SAID FIRE LIMITS; DEFI~~NG
FIRE LIMITS OF THE CITY OF CLERMONT AND OTHER I~TTERS
RELATING THERETO; PROVIDI~G PENALTY FOR VIOLATIONS THEREOF.
BE IT ORDAINED AND ESTABLISHED BY THE CITY COUNCIL OF THE CITY
OF CLERNICNT, FLORIDA:
SECTION I.
DEFINITIONS
(a) Fire Limits of the City of Clermont shall in-
clude all that territory defined as being within the Fire Limits
in Section 1 of Chapter XII of the Revised General Ordinances
of the City of Clermont, duly and regularly passed by the City
Council of the City of Clelmont on6 June 1928 and approved by
the Mayor of Clermont on 19 June 1928.
(b) Structures or buildings in which a business or
concession may be licensed within the Fire Limits of the City of
Clermont shall mean &nd include any and all buildings or structures
permitted to be built, altered or repaired in conformance with
the rules, regulations and restrictions as set out in Sections
4 and 5 of Chapter XII of said Revised General Ordinances.
(c) Concession shall mean any business temporarily
located or licensed in the City of Clermont that is housed in a
portable or temporary building, structure, truck, trailer or tent
erected outside of the Fire Limits or set up in any doorway of
any licensed business or on any vacant lot within the Fire Limits
of this City after or during business hours.
SECTION II. RESTRICTIONS TO LICENSING
(a) That on and after the passage of this Ordinance

no concession or temporary business shall be licensed within the
Fire Lirrlits of the City of Clermont as defined herein unless said
concession or business be housed and operated within the four
walls of a building or structure now located or subsequently built
within the Fire Limits of said City.

(b) No concession or business shall be licensed or
anywise permitted to operate in any doorway or on any porch of
any building or structure or on any vacant lot within the Fire
Limits of the City of Clermont.
(c) No concession shall be licensed or permitted to
be operated within any area to the rear of or between any build-
ings or structures or within any area between the front of any
building or structure and the front of any building or structure
on the opposite side of any street fronting said buildings or
structures within the Fire Limits of said City.
(d) Street carnivals may be licensed to operate on
a street within the Fire Limits provided that said street is
blocked off at each intersection within the area and at the ends
thereof to prevent the entrance or movement therein of any motor
vehicle other than a fire truck, but such license shall not run
for more than 24 hours and one of the city's fire trucks shall
be located at a hydrant within said area with hose connected there-
to and as many firemen shall be on duty during the licensing period
as àeemed necessary by the Fire Chief of the City of Clermont.
No concessions or booths shall be erected within 4 feet of either
side of the center of said street so that the fire truck may have
an unobstructed passage.
SECTION III. NECESSITY OF ORDINANCE
(a) Because of the congestion and fire hazards within
the Fire Limits, the City Council deems this ordinance necessary
for the prevention of fires, public safety and preservation of
life and property.
SECTION IV.
This ordinance shall take effect immediately upon its
passage and approval and all ordinances or parts of ordinances
in conflict herewith are hereby repealed.
SECTION V. PENALTIES
(a) Any person, firm or corpor~tion violating any
of the provisions' of this ordinance shall be fined not more than

$lOO,OO or by imprisonment in the City jail at hard labor not
more than 60 days or both.
(b) Provided each day's operation of said business
or concession shall operate as a separate offense.
