R-2013-33 CITY OF CLERMONT RESOLUTION NO.2013-33 A RESOLUTION OF THE CITY OF CLERMONT PERTAINING TO RED LIGHT SIGNAL VIOLATIONS AS AUTHORIZED BY CLERMONT CITY CODE SECTION 62-40 AND IN ACCORDANCE WITH SECTION 316.008 FLORIDA STATUTES, ESTABLISHING THE ADMINISTRATIVE FEE TO BE COLLECTED FROM VIOLATORS WHO UNSUCCESSFULLY APPEAL ALLEGED RED LIGHT SIGNAL VIOLATIONS; PROVDING FOR CONFLICT AND AN EFFECTVE DATE. WHEREAS, the City of Clermont is vested with authority pursuant to Section 316.0083, Florida Statutes, known as the Mark Wandall Traffic Safety Program to use traffic infraction detectors or cameras to enforce Florida Statute Section 316.074 (1), "Obedience to and required traffic control devices" and Florida Statute Section 316.075(1)(c)(1) "Traffic control signal devices"; WHEREAS, the City Council of the City of Clermont by Ordinance No. 2012-03-C created the City of Clermont Red Light Signal Violation Program, adopting the provisions of Section 316.0083,Florida Statutes; WHEREAS, the City Council has authorized the installation and use of red light signal violation cameras at various locations through out the City; and WHEREAS, this Resolution is necesssary for the implementation of Ordinance No. 2012- 03-C and Section 316.0083, Florida Statutes and promotes the health, safety and welfare of the citizens of Clermont. NOW THEREFORE, BE IT RESOLVED by the City Council of the City of Clermont, Lake County, Florida, as follows: Section 1 The City Council does hereby establish an administrative fee of ONE HUNDRED AND FIFTY DOLLARS ($150.00) to be charged for each alleged red light signal violation that is appealed to the hearing officer. This fee shall be in addition to the per violation penalty set forth in Section 316.0083, Florida Statutes and shall be paid by the alleged violator whose appeal is denied in accordance with applicable law. In the event that the alleged violation is dismissed on appeal by the hearing officer,the administrative fee provided herein shall not be charged to the alleged violator. Section 2 All resolutions or policies of the City in conflict herewith are hereby repealed to the extent of the conflict.
