R-2014-10 CITY OF CLERMONT RESOLUTION NO. 2014-10 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CLERMONT, LAKE COUNTY, FLORIDA AUTHORIZING AND DIRECTING THE CITY MANAGER TO NEGOTIATE AND EXECUTE AN INTERLOCAL AGREEMENT RELATED TO THE DISTRIBUTION OF LAKE COUNTY'S LOCAL OPTION GAS TAX AS AUTHORIZED BY SECTION 336.025, FLORIDA STATUTES AND IN ACCORDANCE WITH THIS RESOLUTION, PROVIDING THAT ANY PRIOR RESOLUTION OR ACT OF THE COUNCIL IN CONFLICT HEREWITH IS REPEALED AND PROVIDING AN EFFECTIVE DATE. WHEREAS, as authorized by Section 366.025, Florida Statutes, the Lake County Board of County Commissioners adopted Ordinance 2014-1 re-imposing the one and two cent Local Option Fuel Tax for a period commencing September 1, 2014 and ending December 31, 2043; WHEREAS, the Lake County Board of County Commissioners adopted Resolution 2014-4 declaring its intent to readopt and extend the one and two cent Local Option Fuel Tax authonzed by Section 366.025, Florida Statutes; WHEREAS, Resolution 2014-4 further provided that if a majonty of the municipalities within Lake County did not adopt an Interlocal Agreement agreeing to a formula for distribution of the municipalities' portion of the Local Option Fuel Tax by June 1, 2014, that the distribution formula set forth in Section 366.025, Florida Statues would be used to distribute the collected tax; WHEREAS, it is in the best interest of.the citizens of the City of Clermont that a formula other then that set forth in Section 366.025, Flonda Statutes, be agreed upon so as to ensure the City of Clermont receives a more equitable share of the tax; and WHEREAS, in order to meet the June 1, 2014 deadline, it is necessary that the Council authorize and direct the City Manager to complete and execute an applicable Interlocal Agreement with the Lake County municipalities in accordance with the provisions of this Resolution. NOW,,THEREFORE, BE IT RESOLVED by the City Council of the City of Clermont, Lake County, Florida that:, SECTION 1. The City Manager is authorized and directed to negotiate an Interlocal Agreement with regard to the distnbution of the municipalities; share of the Lake County Local Option Fuel Tax, in accordance with the following conditions: 1 CITY OF CLERMONT RESOLUTION NO. 2014-10 1. The distribution formula for the tax shall be in accordance with the formula described as the Population and Road Miles Formula described as option 2, in Exhibit"A" attached hereto and incorporated herein. 2. The Lake County share of the collected tax shall not exceed 66.38 percent and the municipal'share shall not be less than 33.62 percent. 3. The Interlocal Agreement shall meet all of the requirements of Section 366.025, Florida Statutes. SECTION 2. The City Manager is specifically authorized to enter into an Interlocal Agreement on behalf of the City Council to include the terms set forth above. SECTION 3. All resolutions, rules, regulations, restrictions or policies of the City of Clermont in conflict herewith are hereby repealed to the extent of the conflict. SECTION 4.
