AN ORDINANCE UNDER THE CODE OF ORDINANCES OF THE
CITY OF CLERMONT, LAKE COUNTY, FLORIDA, AMENDING
SECTION 26-66 OF THE CODE OF ORDINANCES OF THE CITY
OF CLERMONT; REDEFINING THE USE AND REQUIREMENTS
OF RESIDENTIAL SWIMMING POOLS; REPEALING ALL ORDINANCES
IN CONFLICT HEREWITH; PROVIDING FOR SEVERABILITY;
PROVIDING AN EFFECTIVE DATE; AND PROVIDING FOR PUBLICATION
BY POSTING.
THE CITY COUNCIL OF THE CITY OF CLERMONT HEREBY ORDAINS THAT:
SECTION 1
Section 26-66 of the Code of Ordinances of the City of Clermont
is hereby amended to read as follows:
26-66 No swimming pool shall be so located, designed, operated,
or maintained as to interfere with the rights of the adjoining
property. Lights used to illuminate any swimming pool shall be
so arranged and shadowed as to reflect light away from the adjoin-
ing premises. SwimminR pools shall be located back of the front
building line. The minimum side and rear yard setbacks shall be
equal to the minimum side yard requirements for the zone. Residential
swimming pools shall be enclosed by a fence or wall at least four
(4) feet in heiRht. Residential shall mean single family and duplex
dwellings.
SECTION 2
All ordinances or parts of ordinances in conflict herewith
are hereby repealed.
SECTION 3
Should any section or part of a section of this ordinance be
declared invalid by any court of competent jurisdiction, such adjudications
shall not apply or affect any other provision of this ordinance, except
to the extent that the entire section or part of the section may be
inseparatable in meaning and effect from the section to which such holdings
shall apply.
SECTION 4
This Ordinance shall be posted as provided by law and it shall
become law and shall take effect at 12:01 A.M. on the 10th day of August,
A. D. 1973.
