CODE ORDINANCES ORDINANCE NO. l08-C N~ 327 AN ORDINANCE UNDER THE CODE OF ORDINANCES OF THE CITY OF CLERMONT, LAKE COUNTY, FLORIDA, AMENDING SUBSECTION (d) AND SUBSECTION (e) OF SECTION 16-5 OF THE CODE OF ORDINANCES; AMENDING AND REDUCING THE LENGTH OF SERVICE REQUIRED OF A CITY EMPLOYEE FOR THE VESTING OF PENSION AND RETIREMENT BENEFITS FROM TWENTY (20) YEARS TO TEN (10) YEARS; PROVIDING AN EFFECTIVE DATE; PROVIDING FOR SEVERABILITY; PROVIDING FOR PUBLICATION THE CITY COUNCIL OF THE CITY OF CLERMONT HEREBY ORDAINS THAT: SECTION 1. Subsection (d) of Section 16-5 of the Code of Ordinances of the City of Clermont, Lake County, Florida, is hereby amended to read as follows: (d) Retirement prior to normal retirement date: A general employee who has ten years of credited service and has attained his sixtieth birthday may make written application to the City Clerk for early retirement. On recommendation of the City Clerk and approval by the council, the employee may retire on the first day of·any month following, or coinciding with, his sixtieth birthday. In such an event he shall be entitled to and shall be paid an annuity equal in amount to the annuity computed on the basis of normal retirement, except that the amount so computed shall be reduced by five-twelfths of one per cent of said amount for each month that early retirement precedes his sixty-fifth birthday. A fireman or policeman who has ten years of credited service and has attained his fifty-fifth birthday may make written application to the City Clerk for early retirement. On recom- mendation of the City Clerk and approval by the council, the fireman or policeman may retire on the first day of any month following, or coinciding with, his fifty-fifth birthday. In such an event he shall be entitled to and shall be paid an annuity equal in amount to the annuity computed on the basis of normal retirement, except that the amount so computed shall be reduced by five-twelfths of one per cent of said amount·~ for each month that early retirement precedes his sixtieth birthday. SECTION 2. Subsection (e) of Section 16-5 of the Code of Ordinances of the City of Clermont, Lake County, Florida, is hereby amended to read as follows: (e) Termination of service prior to normal retirement: (1) Less than ten years of credited service. If a member of the plan dies or ceases to be a permanent employee prior to his normal retirement date and has less than 10 years of credited service, all rights of the employee in the pension plan will terminate. (2) Ten years or more of credited service. If any member of the plan terminates employment with the city prior to his normal retirement date and has completed ten years or more of credited service, the pension credit earned at termination will be fully . . He may, when he reaches his normal retirement date, make written application to the City Clerk for the pension earned, and in such an event, he shall be entitled to, and he shall be paid, an annuity computed on the same basis as that of other employees who retire on their normal retirement date~ SECTION 3. All Ordinances(or parts of Ordinances in conflict herewith are hereby repealed. SECTION 4. Should any section or part of section of this Ordinance be declared invalid by any court or competent jurisdiction, such adjudications shall not apply or affect any other provision of this Ordinance, except to the extent that the entire section or part of the section may be inseparable in meaning and effect from the section to which such holding shall apply. SECTION 5. This Ordinance shall be published as provided by law and it shall become law and shall take effect on the 1st day of October, A. D. 1974. First Reading this 9th day of July, A.
