CODE ORDINANCES N~ 486 ORDINANCE NO. 170-C AN ORDINANCE UNDER THE CODE OF ORDINANCES OF THE CITY OF CLERMONT, LAKE COUNTY, FLORIDA, AMENDING THE OFFICIAL ZONING MAP OF THE CITY OF CLERMONT, FLORIDA, REFERRED TO IN SECTION 26-1 OF APPENDIX "A" OF THE CODE OF ORDINANCES REZONING THE REAL PROPERTY DESCRIBED HEREIN FROM C-l ZONING CLASSIFICATION TO R-3 ZONING CLASSIFICATION; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; PROVIDING FOR SEVERABILITY; PROVIDING AN EFFECTIVE DATE; AND PROVIDING FOR PUBLICATION. THE CITY COUNCIL OF THE CITY OF CLERMONT HEREBY ORDAINS THAT: SECTION 1. The Official Zoning Map of the City of Clermont, Lake County, Florida is hereby amended by rezoning the following-described property from C-l zoning classification to an R-3 zoning classification: Lot 14, Block 2, Homedale Subdivision, according to the Official Map of the City of Clermont, Lake County, Florida, recorded in Official Records Book 11, page 26, Public Records of Lake County, Florida. SECTION 2. All Ordinances or parts of this ordinance in conflict herewith are hereby repealed. SECTION 3. Should any section or part of this section be declared invalid by any Court of competent jurisdiction, such adjudications shall not apply or affect any other provision of this Ordinance, except to the extent that the entire section or part of the section may be inseparable in meaning and effect from the section to which such holding shall apply. SECTION 4. This Ordinance shall be published as provided by law and it shall become law and take effect immediately upon its Second Reading and Final Passage. Benson The Planning and Zoning Commission, meeting in Public Hearing on March 7th, considered the request of Mrs. Sallie M. Benson for the re-zoning of her property described as: Lot 14, Block 2 Homedale Subdivision from its existing C1 zoning classification to an R3 zoning classification. in order that she might sell the property for a conforming residential use. She is also the owner of abutting Lot 13 which is zoned as residential, but the zoning boundary for residential use and commercial use, bisects her abutting Lots,13 and 14. It was the Commission's unanimous recommendation to Council that the request be granted,and the necessary ordinance was prepared and introduced by Council at their last meeting held on March 14th. Final consideration by Council, in Public Hearing, shall be held on April 25, 1978 in the Council Chambers at 7:30 P.M. All interested persons are invited to attend and be heard.
