CODE ORDINANCES N~ 413 ORDINANCE NO. l41-C AN ORDINANCE UNDER THE CODE OF ORDINANCES OF THE CITY OF CLERMONT, LAKE COUNTY, FLORIDA, AMENDING ARTICLE III OF APPENDIX A OF THE CODE OF ORDINANCES: DEFINING OFF- STREET PARKING SPACES, PROVIDING FOR OFF-SITE SIGNS, PROVIDING FOR ON-SITE SIGNS, PROVIDING FOR CERTIFICATES OF OCCUPANCY, REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; PROVIDING FOR SEVERABILITY; PROVIDING AN EFFECTIVE DATE; AND PROVIDING FOR PUBLICATION. THE CITY COUNCIL OF THE CITY OF CLERMONT, HEREBY ORDAINS THAT: SECTION 1 Subsection 31.1 of Article III of Appendix A of the Code of Ordinances of the City of Clermont, Lake County, Florida, is hereby amended to read as follows: 31.1 Off-Street parking space: An asphalt, concrete or brick space, which is (a) Large enough for an automobile to be easily parked thereon; and (b) Removed from and not located on any municipal street, alley, or public way; and (c) Accompanied by and include an asphalt, concrete or brick driveway for utilization of said off-street parking space. (d) Off-Street parking space and accompanying driveway shall be constructed of asphalt, concrete or paving brick according to the following applicable minimum specifications: (1) Asphalt: One (1) inch cap on four (4) inches of limerock base. (2) Concrete: Four (4) inches of concrete with #lO wire mesh on four (4) inches of limerock base. (3) Brick: Paving brick on compacted sand base. SECTION 2. Subsection 26-19 (D)(l)(e) of Article III of Appendix A of the Code of Ordinances of the City of Clermont, Lake County, Florida, is hereby amended to read as follows: 26-l9 (D)(l)(e). Off-site signs in accordance with the provisions of Section 26-79.11. SECTION 3. Signs above nine (9) feet from grade level to bottom of sign shall not be erected nearer than four and one-half (4~) feet of the property line. (3) One (1) wall sign parallel to the road or street, thirty- two (32) square feet for up to the first twenty-five (25) feet of frontage, thereafter on a one to one ratio not exceeding one hundred sixty (l60) square feet. (4) One (1) marquee sign parallel to the road or street thirty- two (32) square feet for up to the first twenty-five (25) feet of frontage, thereafter on a one to one ratio not exceeding ninety-six (96) square feet. (5) One (l) marquee sign perpendicular to the road or street thirty-two (32) square feet for up to the first twenty- five (25) feet of frontage thereafter on a one to one ratio not exceeding ninety-six (96) square feet. (6) One (l) vehicle/portable sign, not exceeding seventy-two (72) square feet. (2) The following signs are permitted in shopping centers and multi- use buildings: (a) One (1) sign listing the property for sale, lease or rent not over thirty-two (32) square feet in area, per lot or parcel or a maximum of two (2) signs of thirty-two (32) square feet each for lots and parcels over two hundred fifty (250) feet of frontage. . . Section 26-27 of Article III of Appendix A of the Code of Ordinances of the City of Clermont, Lake County, Filiorida, is hereby amended by adding subsection (F)(3) as follows: 26-27 (F)(3). Churches SECTION 10 Subsection 26-27 (D) of Article II of Appendix A of the Code of Ordinances of the City of Clermont, Lake County, Florida, is hereby amended to read as follows: 26-27 (D) Signs. (1) The following signs are permitted: (a) Those signs permitted in the Ml Light Industrial District (2) The following signs are prohibited: (a) Those signs prohibited in the Ml Light Industrial Area. SECTION 11. Section 26-79 of Article III of Appendix A of the Code of Ordinances of the City of Clermont, Lake County, Florida, is hereby amended as follows: 26-79. No sign shall be erected or maintained on, over or above public property or public right-of-way except when such sign does not extend more than four (4) feet over the public property or public right-of-way, is not less than eight (8) feet above the ground level and does not have an area exceeding eight (8) square feet. Signs on the faces of any marquee or awning shall not extend more than two (2) inches beyond the edge of such marquee or awning. This section does not apply to signs posted by duly constituted public authorities in the performance of their public duties. SECTION 12. Section 26-78.8 of Article III of Appendix A of the Code of Ordinances of the City of Clermont, Lake County, Florida, is hereby deleted. SECTION 13. Section 26-79.10 of Article III of Appendix A of the Code of Ordinances of the City of Clermont, Lake County, Florida, is hereby deleted. SECTION 14. Section 26-79.11 of the Article III of Appendix A of the Code of Ordinances of the City of Clermont, Lake County, Florida shall read as follows: 26-79.11 Off-site signs Off-site signs such as "open house", garage sale" and other directional temporary signs may be erected without permit when . . Section 26-79.l7 of Article III of Appendix A of the Code of Ordinances of the City of Clermont, Lake County, Florida is hereby amended to read as follows: 26-79.17. Permit - Applicants; Issuance Application for a sign permit shall be made by the owner of the premises or his agent to the City Manager on a form or forms provided by the City Manager, prior to the erection or placing ôf any sisn proposed; and upon it being made to appear that the sign swill ~e erected or placed in accordance with this article. The City Manager shall issue a permit for said sign to the applicant after the required fee or fees have been paid to the City and after all preliminary requirements have been met. Political signs, and signs of non-profit organizations which are not exempt due to size will require a permit after obtaining permission from the City Manager as to location. SECTION 17. Subsection 26-79.18 (a) of Article III of Appendix A of the Code of Ordinances of the City of Clermont, Lake County, Florida is hereby amended to read as follows: 26-79.18 (a) (a) All sign permits, except vehicle/portable sign permits; $0.20 per square foot of face. Minimum fee $5.00. SECTION l8. Subscrtion 26-79.18 (b) of Article III of Appendix A of the Code of Ordinances of the City of Clermont, Lake County, Florida is hereby amended to read as follows: 26-79.18 (b) (b) Vehicle/portable signs: $0.20 per square feet of face.
