RESOLUTION NO. 2015-13
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CLERMONT, LAKE COUNTY, FLORIDA APPROVING AND
AUTHORIZING THE PAYMENT TO THE UNITED STATES
ENVIRONMENTAL PROTECTION AGENCY (EPA) OF $145,750 IN
ACCORDANCE WITH THE EPA ASSISTANCE AGREEMENT
RELATED TO A PORTION OF THE CITY'S FORMER SPRAY FIELD
AT THE CORNER OF CATHEDRAL LANE AND MAX HOOKS ROAD;
AUTHORIZING THE ACCEPTANCE OF A QUIT CLAIM DEED FROM
EPA IN EXCHANGE FOR PAYMENT AND AUTHORIZING THE
MAYOR TO EXECUTE A QUIT CLAIM DEED TO LAKE COUNTY,
FLORIDA FOR THE SUBJECT PROPERTY IN ACCORDANCE WITH
THE TERMS OF THAT CERTAIN INTERLOCAL AGREEMENT
DATED JANUARY 9, 2007 AS AMENDED BETWEEN THE CITY OF
CLERMONT AND LAKE COUNTY FOR THE PRESERVATION OF
NATURAL AND HISTORIC RESOURCES AND PROVIDING FOR AN
EFFECTIVE DATE.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Clermont, Lake County, Florida, that:
SECTION 1.
The City Council does hereby approve the payment of $145,750 to the United States
Environmental Protection Agency (EPA) in accordance with and in satisfaction of an
EPA lien on former spray filed property formerly owned by the City and acquired by the
City with partial grant funds pursuant to EPA Assistance Agreement Number C-120503-
03-0, Clean Air Act Title 11.
SECTION 2.
In exchange for the above-referenced payment, the City Council does hereby accept a
quit claim deed from EPA, transferring all interest that EPA may have in the subject
property to the City.
SECTION 3.
By previous act, the City Council approved the transfer of the subject property and
related interest to Lake County Florida. In fulfillment of the terms and conditions of that
certain Interlocal Agreement between the City and Lake County dated January 9, 2007
and as amended, the Mayor is authorized and directed to execute the Quit Claim Deed in
favor of Lake County attached hereto as Exhibit 'A'.
SECTION 4.
This resolution shall take effect immediately upon its adoption.
