ORDINANCE No. 2015-38
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
CLERMONT, LAKE COUNTY, FLORIDA, PROVIDING FOR THE
ANNEXATION OF A CERTAIN PARCEL OF LAND IN ACCORDANCE
WITH THE INTERLOCAL SERVICE BOUNDARY AGREEMENT
DATED DECEMBER 2, 2014; PROVIDING FOR AN EFFECTIVE DATE,
SEVERABILITY, RECORDING, AND PUBLICATION.
WHEREAS, the City Council of the City of Clermont, Florida approved a Utility
Service Agreement for Water and Wastewater for the subject property, dated February 13, 2003;
and
WHEREAS, in accordance with the Clermont Interlocal Service Boundary Agreement
dated December 2, 2014, the subject property is eligible to be annexed into the City; and
WHEREAS, the City Council of the City of Clermont, Florida, has determined that it is
in the best interest of the City and of the property herein sought to be annexed that the City
annex the following descnbed property; and
WHEREAS, the City Council has determined that the area sought to be annexed is in
need of the services which the City can offer and the City has determined that such area sought
to be annexed will be substantially benefited by annexation; and
WHEREAS, the City Council has determined that all requirements of Section 171.044,
Florida Statutes,have been met.
SECTION 1.
NOW, THEREFORE, BE IT ORDAINED, under the provisions of Flonda Statute
Chapter 171 and the General and Special Laws of the State of Flonda; that the City of Clermont,
Florida, does hereby annex to and make part of its corporate boundanes; the following described
property, to-wit:
Legal Descnption
A portion of Tracts 3, 4, 13, and 14 of Lake Highlands Company subdivision of Section 26,
Township 22 south, Range,26 east, according to the plat thereof as recorded in Plat Book 3, Page
52 of the Public Records of Lake County, Flonda being more particularly descnbed as follows:
Commence at the north '/ corner of said Section 26; thence south 00o40'30" West, 244.02 feet
along the west line of the northeast % of said Section 26; thence south 89o34' 59" east, 33.00
feet-parallel with the north line of the northeast '/ of said Section 26 to the Point of Beginning;
thence continue along said parallel line, south 89 34'59" east, 700.01 feet, thence south 00
40'30" west, 879.12 feet parallel with aforesaid west line of the northeast '/ of said Section 26 to

Transportation Right-of-Way Map Section No. 11070-2505; thence north 88 54'49" west, 683.02
feet along said north nght-of--way thence north 00 40'30" East, 457.01 feet, thence north 89
32'33" west, 17 00 feet to a point on the east right-of-way line of County Road 455, thence north
00 40'30" East along said nght-of-way line, 414.11 feet to the Point of Beginning,
Containing 13.88 acres, more or less

SECTION 2.
That the, aforedescnbed property shall be and hereby is made part and parcel of the City of
Clermont, Florida, and that said property shall be subject to all of the laws, ordinances, and
provisions pertaining to the City of Clermont.
SECTION 3.
All property aforedescnbed shall henceforth be subject to ad valorem taxation by the City of
Clermont, and any other general or special taxes or assessments.
SECTION 4.
Should any Section or part of a Section be declared invalid by any court of competent
jurisdiction, such adjudications shall not apply or affect any other provision of this Ordinance,
except to the extent that the entire Section or part of the Section may be separable in meaning
and effect from the Section to'which such holding shall apply.
SECTION 5.
This'Ordinance shall be recorded in the public records of Lake County, Flonda.
SECTION 6.
This Ordinance shall be published as provided by law, and it shall become law and take effect
upon its Second Reading and Final Passage.
