ORDINANCE No. 2015-35
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
CLERMONT, LAKE COUNTY, FLORIDA, PROVIDING FOR THE
ANNEXATION OF A CERTAIN PARCEL OF LAND IN ACCORDANCE
WITH THE INTERLOCAL SERVICE BOUNDARY AGREEMENT
DATED DECEMBER 2, 2014; PROVIDING FOR AN EFFECTIVE DATE,
SEVERABILITY, RECORDING, AND PUBLICATION.
WHEREAS, the City Council of the City of Clermont, Florida approved a Utility
Service Agreement for Water and Wastewater for the subject property that includes a Notice of
Encumbrance to annex, dated November 24, 2003; and
WHEREAS, in accordance with the Clermont Interlocal Service Boundary Agreement
dated December 2, 2014, the subject property is eligible to be annexed into the City; and
WHEREAS, the City Council of the City of Clermont, Flonda, has determined that it is
in the best interest of the City and of the property herein sought to be annexed that the City
annex the following described property; and
WHEREAS, the City Council has determined that the area sought to be annexed is in
need of the services which the City can offer and the City has determined that such area sought
to be annexed will be substantially benefited by annexation; and
WHEREAS, the City Council has determined that all requirements of Section 171.044,
Florida Statutes, have been met.
SECTION 1.
NOW, THEREFORE, BE IT ORDAINED, under the provisions of Flonda Statute
Chapter 171 and the General and Special Laws of the State of Florida; that the City of Clermont,
Florida, does hereby annex to and make part of its corporate boundaries; the following described
property, to-wit:

That part of lots 39, 40, 41, and 42, of Lake Highlands Company, a subdivision in Section 26,
Township 22 south, Range 26 east, according to the record plat thereof, recorded in PB 3, PG 52,
in the Public Records of Lake County, Florida,bounded and described as follows:
Commence at the southwest corner of lot 57, of said Lake Highlands Company, and run north
00°10'49" east, along the west line of lots 57, 56 and 41, of said Lake Highlands Company, a
distance of 1,682.40 feet to the point of beginning of this description; from said point of

beginning, continue north 00°10'49" east, along the west line of lots 41 and 40, of said Lake
Highlands Company, a distance of 969.87 feet to the northwest corner of said lot 40; thence
south 89°34'10" east, along the north line of said lot 40, a distance of 472.27 feet; thence south
00°25'50" west, 191.77 feet; thence south 89°28'34" east, 455.72 feet to the beginning of a curve
concaved southwesterly and having a radius of 35.00 feet; thence easterly and southerly, along
the arc of said curve, through a central angle of 89°48'41", an arc length of 54.86 feet, to the end
of said curve; thence south 00°20'07" west, 742.66 feet; thence north 89°33'15" west, 959.93
feet to the point of beginning. Subject to all easements, rights-of-way and restrictions of record,
if any.

SECTION 2.
That the aforedescribed property shall be and hereby is made part and parcel of the City of
Clermont, Florida, and that said property shall be subject to all of the laws, ordinances, and
provisions pertaining to the City of Clermont.
SECTION 3.
All property aforedescribed shall henceforth be subject to ad valorem taxation by the City of
Clermont, and any other general or special taxes or assessments.
SECTION 4.
Should any Section or part of a Section be declared invalid by any court of competent
jurisdiction, such adjudications shall not apply or affect any other provision of this Ordinance,
except to the extent that the entire Section or part of the Section may be separable in meaning
and effect from the Section to which such holding shall apply.
SECTION 5.
This Ordinance shall be recorded in the public records of Lake County, Florida.
SECTION 6.
This Ordinance shall be published as provided by law, and it shall become law and take effect
upon its Second Reading and Final Passage.
