ORDINANCE NO. 178-C
AN ORDINANCE UNDER THE CODE OF ORDINANCES OF THE CITY OF
CLERMONT, LAKE COUNTY, FLORIDA, AMENDING SECTION 26-61 OF
ARTICLE IX OF APPENDIX A OF THE CODE OF ORDINANCES; PRO-
VIDING FOR FRONT YARD SETBACKS FOR DWELLINGS; REPEALING
ALL ORDINANCES IN CONFLICT HEREWITH; PROVIDING FOR SEVER-
ABILITY; PROVIDING AN EFFECTIVE DATE; AND PROVIDING FOR
PUBLICATION.
THE CITY COUNCIL OF THE CITY OF CLERMONT, LAKE COUNTY, FLORIDA, HEREBY
ORDAINS THAT:
SECTION 1.
Section 26-61 of Article IX of Appendix A of the Code of Ordinances of
the City of Clermont, Lake County, Florida, is hereby amended to read as follows:
If dwellings adjacent to and within one hundred (100) feet of
a lot are forward of the front yard setback established by
this ordinances, the minimum front:yard setback on the lot
shall be the average setback of the adjacent dwellings, or in
the case of a corner lot, the setback of the adjacent dwelling.
SECTION 2.
All ordinances or parts of ordinances in conflict herewith are hereby
repealed.
SECTION 3.
Should any section or part of this section be declared invalid by any
Court of competent jurisdiction, such adjudications shall not apply or affect
any other provision of this ordinance, except to the extent that the entire
section or part of the section may be inseparable in meaning and effect from
the section to which such holding shall apply.
SECTION 4.
This ordinance shall be published as provided by law and it shall become
law and shall take effect 30 days from the date of its Second Reading and Final
Passage.
