O-319-C .- City of Clermont Ordinance No. 319-C Page I -, AN ORDINANCE OF THE CITY OF CLERMONT, FLORIDA DEALING WITH CHAPTER 26 "ELECTIONS", ADDING A NEW SECTION 26-10 TO THE CITY CODE, SPECIFICALLY AUTHORIZING THE USE OF PAPER BALLOTS IN CERTAIN MUNICIPAL ELECTIONS WHEN SPECIFICALLY AUTHORIZED BY RESOLUTION OF THE CITY COUNCIL; PROVIDING FOR CONFLICTS, SEVERABILITY, CODIFICATION; AND, PROVIDING FOR AN EFFECTIVE DATE WHEREAS, as a result of state election law reforms, certain new time were mandated that require the City of Clermont to conduct municipal elections utilizing paper ballots; and, WHEREAS, when the city has a primary election required to be conducted five weeks prior to the state general election, then it will be necessary under state law as currently written that the city conduct its own election; and, WHEREAS, when the City conducts its own elections, the City Council is hereby empowered by this ordinance to authorize by resolution, the use of paper ballots in any such municipal election conducted by the City or others on behalf of the City. NOW THEREFORE BE IT ORDAINED by the City Council of the City of Clermont as follows: SECTION 1. A new Section 26-10 entitled "Paper Ballots Authorized for Municipal Elections in Certain Circumstances" is hereby added to the City Code of the City of Clermont, and said Section 26-10 is hereby created to read as follows: Section 26-10: Paper Ballots Authorized for Municipal Elections in Certain Circumstances Paper ballots may be utilized as the means of conducting municipal elections when authorized by resolution of City Council. In these instances, the City of Clermont shall provide for use of a paper ballot by which voters shall mark their votes upon the paper ballot by hand and the votes shall be tabulated and counted by hand by the City Clerk or other official so designated by the City Council. Specific procedures to be employed in a paper ballot election shall be set by the City Clerk or other official if designated, and as approved by the City Council. Those members of the City Council who are not involved in the election conducted in accordance with this section, shall serve as the elections canvassing board and shall resolve all issues involved in elections conducted in accordance with this section and shall certify the election results. ...~;' .' ~ ~ , S''' ....,-. -"" ." - ~ ~ . - - ~-:- : ~~ .,." ~.."" " ;~'" e e: City of Clermont Ordinance No. 319-C Page 2 SECTION 2. All provisions of any ordinance in conflict in this ordinance are hereby repealed to the extent of any such conflict. SECTION 3. If a court of competent jurisdiction declares any word, section or portion of this ordinance invalid for any reason, such invalidity shall not affect the remaining provisions of this ordinance. SECTION 4. This ordinance shall be codified in the City Code of the City of Clermont. SECTION 5. This ordinance shall be effective immediately upon its passage by the City Council. ;,-;'_' .-_V - .
