CITY OF CLERMONT ORDINANCE NO. 312~C Page I AN ORDINANCE UNDER THE CODE OF ORDINANCES OF THE CITY OF CLERMONT, LAKE COUNTY, FLORIDA, AMENDING ORDINANCE 195, AS AMENDED AND INCORPORATED IN CHAPTER 46 OF THE CODE OF ORDINANCES OF THE CITY OF CLERMONT, PROVIDING FOR REVISIONS TO THE PENSION PLAN OF THE CITY OF CLERMONT, FLORIDA, PROVIDING FOR SEVERABILITY, PROVIDING FOR PUBLICATION; AND PROVIDING FOR AN EFFECTIVE DATE. The City Council of the City of Clermont, hereby ordains that: SEcnON 1. Chapter 46, Article II, Section 46-102 is hereby amended to read: , (a) A member retiring under this article on or after his normal retirement date shall elect to have his benefits payable under any of the options outlined in section 46-107. (b) The monthly normal retirement benefit for general employees and firefighters shall be equal to two percent of average monthly earnings, times years of creditable service. In no event, however, will a monthly benefit be less than 52.00 times years of creditable service. (c) The monthly n0I111al retirement benefit for volunteer firefighters shall be 55.00 times years of creditable service. . . CITY OF CLERMONT ORDINANCE NO. 312-C Page 2 (d) The monthly normal retirement benefit for police officers shall be equal to 2.25 percent of average monthly earnings, times years of creditable service. In no event, however, will a benefit be less than $2.00 times years of creditable service. (e) Effective October I, 1992 all retirees who retired prior to October I, 1986 shall receive an increase in their monthly retirement benefit amount in the amount of $2.00 per year of creditable service. ([) Effective October 1. 2001' all'retiiees who retired prior to September 30. '.. '." 2001 shall receive an increase in their monthly retirement benefit amount. in the amount of $2.00 per year of creditable service. SECTTON 2. All ordinances or parts of Ordinances in conflict herewith are hereby repealed. SECTTON 1. Should any section or part of a section be declared invalid by any Court of competent jurisdiction, such adjudication shall not apply to or affect any other section or provision of this Ordinance except to the extent that the entire section or part of a section may be inseparable in meaning and effect from the section to which such holding shall apply. . . . First Reading this 25th day of September, 200 I. Second Reading this 9th day of October, 2001.
