CITY OF CLERMONT ORDINANCE No. 290-C AN ORDINANCE OF THE CODE OF ORDINANCES OF THE CITY OF CLERMONT, LAKE COUNTY, FLORIDA, AMENDING THE CODE OF ORDINANCES, CHAPTER 90, CONCURRENCY MANAGEMENT, SECTION 90-7(d), ESTIMATION OF DEMAND FOR PROPOSED DEVELOPMENT; AND AMENDING CHAPTER 122, SECTIONS 122-164 AND 122-184, CONDITIONAL USES IN THE R-3-AAND R-3 RESIDENTIALI PROFESSIONAL DISTRICTS; AND CHAPTER 122, BOAT HOUSES AND DOCKS IN RESIDENTIAL AREAS, SHALL BE AMENDED TO COMPLY WITH STATE AND FEDERAL REGULATIONS; PROVIDING FOR SEVERABILITY; PROVIDING FOR AN EFFECTIVE DATE, AND PROVIDING FOR PUBLICATION. The City council of the City of Clermont hereby ordains that: SECTION 1. Chapter 90, Concurrency Management, Section 90-7(d), Estimation of Demand for Proposed Development, be amended to read as follows: Analysis of traffic distribution on the road network, including all links impacted by more than five tef¡ percent of project traffic or 500 trips per day, whichever is greater. The analysis of traffic distribution shall use the variable radii approach for traffic analysis, as outlined in this section. Where appropriate, the study area radii may be expanded to include a nearby intersection, or otherwise modified to provide for a more accurate assessment of specific projects, including developments of regional impact. SECTION II. Chapter 122, Sections 122-164 and 122-184, Conditional Uses in the R-3-A and R-3 Residential/Professional Districts shall be amended to include the following: Beauty shops or barber shops. SECTION III. Chapter 122, Boat Houses and Docks shall be permitted uses in all residential districts and shall be amended to read as follows: Private docks and boathouses, provided that such structures maintain a twenty-five (25) foot side yard setback. A ten (10) foot side yard setback may be allowed upon receipt of properly authorized documentation from directly abutting property owners. It shall be further provided that such structures comply with state and/or federal regulations, as applicable. Chapter 122, all references to Boat Houses and Docks as conditional uses shall be eiiminated. 1 ... . . CITY OF CLERMONT ORDINANCE No. 290-C SECTION IV. All other conditions shall remain in full force and effect. SECTION V. All Ordinances or parts of this Ordinance in conflict herewith are hereby repealed. SECTION VI. Should any section or part of this section be declared invalid by any court of competent jurisdiction, such adjudications shall not apply to or affect any other provision of this Ordinance, except to the extent that the entire section or part of the section may be inseparable in meaning and effect from the section to which such holding shall apply. SECTION VII. This Ordinance shall be published as provided by law and it shall become law and shall take effect immediately upon its Second Reading and Final Passage. First Reading on the 13th day of October 1998. Second Reading on the 2th day of October 1998.
