AN ORDINANCE OF THE CODE OF ORDINANCES OF THE
CITY OF CLERMONT, LAKE COUNTY, FLORIDA, AMENDING
THE CODE OF ORDINANCES, LAND DEVELOPMENT CODE,
CHAPTER 16 l\fiSCELLANEOUS REGULATIONS, AMENDING
SECTION 7 SPECIAL PERl\fiTS; PROVIDING FOR
SEVERABILITY; PROVIDING FOR AN EFFECTIVE DATE, AND
PROVIDING FOR PUBLICATION.
The City Council of the City of Clermont hereby ordains that:
SECTION I. Chapter 16, Section 7, (A) Open Air Sales Permits of the Code
of Ordinances, Land Development Code be amended to read as follows:
SECTION 7: SPECIAL PERl\fiTS
(A) Open Air Sales Permits
All retail or wholesale sales must be located within a completely enclosed
building, unless an open air sales permit has been issued. Open wr salcs
permits of thirty (30) days or less may bc issued by thc City Managcr. Open
wr salcs permits greater than thirty (30 days must bc approved by thc City
C6t1fteil. The City Manager may issue an open air Jiales permit usin~ the
following criteria:
1) One permit per calendar year may be issued for a maximum of 30
consecutive days.
2) A written request must be submitted setting forth the name and address
of the applicant. location of the proposed operation. description of the
proposed operation. number of days for which the permit is desired. and
property owner permission (if I\Pplicable).
3) One two-sided sign. the maximum of eight (8) square feet shall be
allowed and shall be set back a minimum of 10' from all property lines.

4) Exceptions
a) Open storage for the sale of automobiles. farming implements.
trailers. boats. and gasoline are exempt from this section.
b) Open air sales permits for greater than 30 days may be issued in
the Central Business District and shopping centers in C-2 Districts
if the open air sales are directly related to the eJitablished business
on the subject site.
(1) Permit Any person dcsiring an open air salcs pcrmit shall submit a rcqucst in
writing to thc City Managcr sctting forth thc namc and addrcss of thc applicant,
location of propooed operation, numbcr of days for which a permit is dcsired
and thc operation to be carried out undcr this permit.
(2) Rcvocation Any open air salcs pcrmit issued hcrcundcr may bc revoked by thc
City Council for any violation of thc Codcs of thc City of Clcrmont.
(3) Exccptions
(a) Opcn storagc for the salc of automobilcs, farm implcmcnts, trailers,
boats and gasolinc arc cxcmpt from thc provisions of this scction, but all
such opcn storagc is prohibited on City rights of way.
(b) Open Air Salcs Permit for greater than thirty (30) days may bc issued
upon approval of thc City Managcr in thc Ccntral Busincss District and
shopping ccnters located in C 2 Zoning Districts.
SECTION n. All other conditions shall remain in full force and effect.
SECTION m. Should any section or part of a section be declared invalid by
any Court of competent jurisdiction, such adjudication shall not apply to or affect any

other section or provision of this Ordinance except to the extent that the entire section
or part of a section may be inseparable in meaning and effect from the section to
which such holding shall apply.
SECTION IV. This ordinance shall be published as provided by law and it
shall become law and shall take effect immediately after its Second Reading.
