AN ORDINANCE UNDER THE CODE OF ORDINANCES OF THE
CITY OF CLERMONT, LAKE COUNTY, FLORIDA, AMENDING
SECTION 26 - 28 OF THE CITY OF CLERMONT ZONING
ORDINANCE (ORDINANCE NO. 245-C) RELATING TO OPEN AIR
SALES PERMITS; PROVIDING FOR APPROVAL BY THE CITY
COUNCIL; REPEALING ALL ORDINANCES IN CONFLICT
HEREWITH; PROVIDING FOR SEVERABILITY; AND PROVIDING
FOR AN EFFECTIVE DATE.
THE CITY COUNCIL OF THE CITY OF CLERMONT HEREBY ORDAINS
THAT:
SECTION 1.
Section 26-28 Open Air Sales Permits, of the City of Clermont Zoning
Ordinance is hereby amended by adding the following:
(d) Approval by City Council
1. Open air sales permits for a period greater than thirty (30) days
may be approved by the City Council upon a showing that such
use shall not be detrimental to the health, safety, or general
welfare of persons residing or working in the vicinity.
2. Such permit may be granted upon a showing by the permittee that
the activity shall be confined to a specific parcel of property not
otherwise utilized; shall be a minimum of 100 feet from Highway
50; and that no other open air sales permit has been granted by
the City Council within one (1) mile, except for open air sales
permits in conjunction with an established retail establishment.
3. Signs for open air sales are limited to one two-sided sign of a
maximum of eight (8) square feet per side.

SECTION 2.
All Ordinances or parts of Ordinances in conflict herewith are hereby repealed.
SECTION 3.
Should any section of part of a section be declared invalid by any Court of
competent jurisdiction, such adjudication shall not apply to or affect any other section
or provision of this Ordinance except to the extent that the entire section or part of a
section may be inseparable in meaning and effect from the section to which such
holding shall apply.
SECTION 4.
This ordinance shall be published as provided by law and it shall become law
and take effect on the date of its Second Reading and Final Passage.
First Reading this 10th day of August, 1993.
Second Reading this 14th day of September, 1993.
