ORDINANCE NO. 201-C
AN ORDINANCE UNDER THE CODE OF ORDINANCES OF THE CITY OF CLERMONT,
LAKE COUNTY, FLORIDA, AMENDING CHAPTER 6, CEMETERIES, SECTION 6-9,
TRUST FUND; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; PROVIDING
FOR SEVERABILITY; PROVIDING FOR AN EFFECTIVE DATE; AND PROVIDING
FOR PUBLICATION.
THE CITY COUNCIL OF THE CITY OF CLERMONT, LAKE COUNTY, FLORIDA, HEREBY ORDAINS
THAT:
SECTION 1.
Chapter 6, CEMETERIES, Section 6-9, Trust Fund, of the Clermont Municipal Code
of Ordinances is hereby amended as follows:
Section 6-9:
There is hereby established a trust fund, to be known as "The
Clermont Cemetery Petpetual Care Fund", to be derived from
twenty-five percent (25%) of the net proceeds for all residential
cemetery lot sales, and sixty-two percent (62%) of the net fee
for non-residential lot sales. The council shall be trustees
thereof and may invest and re-invest same as it deems necessary.
The annual cost of care and maintenance of the cemetery shall be
paid out of only the interest or dividends earned by the trust
fund and the general taxes assessed and levied for such purpose.
The principal must be kept separate and apart from all other funds
of the city and its use is hereby appropriated exclusively for the
purpose of said trust.
SECTION 2.
All Ordinances or parts of Ordinances in conflict herewith are hereby repealed.
SECTION 3.
Should any section or part of this section be declared invalid by any court
of competent jurisdiction, such adjudications shall not apply or affect any other
provision of this Ordinance, except to the extent that the entire section or part
of the section may be inseparable in meaning and effect from the section to which
such holding shall apply.
SECTION 4.
This Ordinance shall be published as provided by law and it shall become law
and shall take effect immediately after its Second Reading and Final Adoption.
