ORDINANCE NO. 194-C
AN ORDINANCE UNDER THE CODE OF ORDINANCES OF THE CITY OF CLERMONT,
LAKE COUNTY, FLORIDA; AMENDING SECTION 26-25 (B) (2) OF ARTICLE VI
OF APPENDIX A OF THE CODE OF ORDINANCES; PROVIDING FOR RETAIL USE;
REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; PROVIDING FOR SEVERA-
BILITY; PROVIDING FOR AN EFFECTIVE DATE; AND PROVIDING FOR PUBLICATION.
The City Council of the City of Clermont, Lake County, Florida, hereby ordains
that:
SECTION 1.
Section 26-25 (B) (2) of Article VI of Appendix A of the Code of Ordinances is
hereby amended to read as follows:
26-25 (B) (2). Any retail business or service, including the making of products
sold at retail on the premises, providing such manufacturing is incidental to the
retail business or service, occupies less than forty percent (40%) of the floor area,
and employs not more than five (5) operators. Retail business or service may include
the sale of goods or services for resale as long as it is incidental to providing goods
and services to the ultimate consume~. The keeping of normal business hours for sales
to ultimate consumers shall constitute prima facie evidence that such use qualifies
under this section.
SECTION 2.
All ordinances or parts of this Ordinance in conflict herewith are hereby repealed.
SECTION 3.
Should any section or part of this section be declared invalid by any Court
of competent jurisdiction, such adjudications shall not apply or affect any other
provision of this Ordinance~ except to the extent that the entire section or part
of the section may be inseparable in ~eaning and effect from the section to which
such holding shall apply.
SECTION 4.
This Ordinance shall be published as provided by law and it shall become law
and shall take effect on the date of its Second Reading and Final Passage.
