AN ORDINANCE UNDER THE CODE OF ORDINANCES OF THE CITY OF CLERMONT,
LAKE COUNTY, FLORIDA, CLOSING AND PERMANENTLY ABANDONING A PORTION
OF ALMOND STREET DESCRIBED HEREIN, ACCORDING TO THE OFFICIAL MAP
OF THE CITY OF CLERMONT, RECORDED IN PLAT BOOK 4, PAGE 1, PUBLIC
RECORDS OF LAKE COUNTY, FLORIDA; REPEALING ALL ORDINANCES IN
CONFLICT HEREWITH; PROVIDING FOR SEVERABILITY; PROVIDING FOR AN
EFFECTIVE DATE; AND PROVIDING FOR PUBLICATION.

The City Council of the City of Clermont, Lake County, Florida, hereby ordains that:
SECTION 1.
That portion of Almond Street located within the City of Clermont, Lake County,
Florida, as hereinafter described, is hereby closed and permanently abandoned:
That part of Almond Street as shown on the Plat of Clermont Heights,
Plat Book 4, page 1, Public Records, Lake County, Florida,lying
between the Southerly right of way line of State Road 50, and a line
described as beginning on the North line of Almond Street at a point
282.27 feet South 89043'58" East from the Southwest corner of Lot
178 of said Clermont Heights, and running South 25033'12" West, 11.42
feet to the beginning of a curve concave to the Northwesterly and
having a radius of 117.91 feet; thence along said curve through a
central angle of 24029'53" a distance of 50.42 feet to a point of
intersection with the South line of Almond Street and the end of
the line being herein described.
Less and except the reservation by the City of Clermont for an
easement over the above-described property for utilities purposes.
SECTION 2.
This closing is done pursuant to the authority of the Charter of the City of
Clermont, Lake County, Florida, and the general laws of the State of Florida.
SECTION 3.
All ordinances or parts of this Ordinance in conflict herewith are hereby repealed.
SECTION 4.
Should any section or part of this section be declared invalid by any Court
of competent jurisdiction, such adjudications shall not apply or affect any other
provision of this Ordinance, except to the extent that the entire section or part
of the section may be inseparable in meaning andefle-c:e. from the section to which

such holding shall apply.
SECTION 5.
This Ordinance shall be published as provided by law and it shall become law
and shall take effect 30 days from the date of its Second Reading and Final Passage.

I recommend that the petition be approved and the necessary ordinance
be adopted.
After talking with Mr. Turner, we determined that if the City abandoned
only the outer 15 feet on each side, he would have the required lot size and
the City would retain an ample 70' right-of-way in the event that a street is
ever needed.
Mr. Sherrill Turner has requested that the portion of Lake Avenue
right-of-way between Osceola Street and the railroad be closed and abandoned.
The purpose of this request is to allow him to sell a portion of his property
and maintain the lot size required by our Code. (The property he intends to
sell contains two duplexes and requires 20,000 square feet.)
