Request for Vacation of Right-of-Way
Location: Lake Shore Drive (adjacent to lots 11-14, Block 117)
Applicant: Josef and Weena Trapp
Application Date: December 19, 2016
The application was heard by the City Council for a vacation for right-of-way, whereupon, the City
Council, based on the information and evidence presented at the April 25, 2017 public hearing, does
hereby find that the proposed and requested vacation of right-of-way application does not meet the review
criteria set forth in Section 86-144 of the Land Development Code of the City of Clermont.
NOW,THEREFORE,the City Council of the City of Clermont, Lake County,Florida by
a 5-0 vote does hereby deny the above-stated application for vacation of right-of-way.
DONE AND RESOLVED by the City Council of the City of Clermont, Lake County,
Florida, this 25th day of April, 2017.

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
CLERMONT, LAKE COUNTY, FLORIDA, CLOSING AND
PERMANENTLY ABANDONING THE 40 FOOT RIGHT-OF-WAY
OF LAKE SHORE DRIVE LYING NORTH OF LOTS 11 THRU 18,
BLOCK 117, AS RECORDED IN THE PLAT OF JOHNSON'S
REPLAT PLAT BOOK 8 PAGE 71 PUBLIC RECORDS OF LAKE
COUNTY, FLORIDA; REPEALING ALL ORDINANCES IN
CONFLICT HEREWITH, PROVIDING FOR SEVERABILITY,
PUBLICATION, RECORDING, AND FOR AN EFFECTIVE DATE.
NOW THEREFORE, BE IT RESOLVED AND ENACTED by the City
Council of the City of Clermont, Lake County, Florida that:
Section 1.
That any and all portions, closing and permanently abandoning the 40-foot wide right-of-
way easement of Lake Shore Drive lying north of lots 11 thru 18, Block 117, as recorded
in the plat of Johnson's Replat Plat Book 8 Page 71 Public Record of Lake County,
Florida.
Section 2.
The closing is done pursuant to the authority of the Charter of the City of Clermont, Lake
County, Florida and the general laws of the State of Florida.
Section 3.
If any portion of this Ordinance is declared invalid, the invalidated portion shall be
severed from the remainder of the Ordinance, and the remainder of the Ordinance shall
continue in full force and effect as if enacted without the invalidated portion, except in
cases where such continued validity of the remainder would clearly and without doubt
contradict or frustrate the intent of the Ordinance as a whole.
Section 4.
All ordinances or parts of ordinances in conflict with any of the provisions of this
Ordinance are hereby repealed.
Section 5.
This Ordinance shall be published as provided by law and it shall become law and shall
take effect immediately upon its Second Reading and Final Passage.
