THE CITY COUNCIL OF THE CITY OF CLERMONT HEREBY ORDAINS THAT:
SECTION 1.
That portion of Carroll Street located within the City of Clermont,
Lake County, Florida, as hereinafter described, is hereby closed and permanently
All that portion of Carroll Street bounded on the
West by the East right of way line of West Lake Drive
and bounded on the East by the West boundary of
Government Lot 8, according to the Official Map of
the City of Clermont, Florida, recorded in Plat Book 8,
pages 17-23 inclusive, Public Records of lake County,
Florida.

SUBJECT, HOWEVER, to this RESERVATION of a permanent utility ease-
ment and right-of-way over, across, under and through a portion of the above-described
property that is 30 feet wide, fifteen feet either side of the said Carroll Street,
extending from the East right of way line of West Lake Drive to the West boundary
of the said Government Lot 8.
RESERVING unto the City the perpetual right to enter upon said
easement at any time it may see fit, to construct, maintain and repair water, drainage,
sewer, electric power and other utility facilities over, across, through and under
the land upon which said easement is reserved, with the right to excavate and refill
ditches and/or trenches for' the location of said pipeline and/or ditches, and
further reserving the right to move trees, bushes, undergrowth and other obstructions
interfering with the location, construction and maintenance of said pipelines and/or
ditches. The City of Clermont shall be in no way responsible or liable for damges
from whatsoever cause incidental to the exercise of the right herein reserved unto
the City.

SECTION 2.
This closing is done pursuant to the authority of the Charter of
the City of Clermont, Lake County, Florida, and the general laws of the State of
Florida.
SECTION 3.
This Ordinance shall be posted and published as provided by law
and it shall become law and take effect thirty (30) says from the date of its
second reading
and final passage.

At their meeting last evening, the City Council considered
your request for the closing of a portion of the àbove
referenced street. '
Please be advised that the request was granted contingent
upon receiving a registered survey indicating the location
of our sanitary sewer lift station in relation to the portion
of street to be closed.
If the survey reveals that the lift station is located in
any portion of the area to be closed then a utility easement
must be' executed prior to passage of the ordinance closing
the street.

The undersigned hereby petitions the City of Clermont to close
and permanently abandon that portion of Carroll Street between West Lake
Drive and the west boundary line of Government Lot 8, City of Clermont,
and in support of this petition offers the following information in
accordance with the prescribed procedure for street closing:
A. The petitioner's name and mailing address is:
Clermont Builders Supply, Inc.,
P.O. Box 158,
Clermont, Florida 32711
B. The legal description of the petitioner's property involved is:
Lots 1 through 13, Block 115, Johnson's Replat, City of Clermont,
abutting Carroll Street on the north.
C. A plot plan showing the property involved and the portion of the
street requested to be closed and permanently abandoned is attached to this
petition and made a part hereof.
D. The purpose for which the street is requested to be closed is as
follows: Clermont Builders Supply, Inc. uses property on both sides of
Carroll Street for business purposes, and in view of the fact that the
portion of Carroll Street requested to be closed and abandoned is not now
opened and maintained as a street, and there is no foreseeable need for this
section of Carroll Street to be used by the public as a street, Clermont
Builders Supply, Inc. wishes this section to be closed in order to make
better use of their property for business purposes. It may also be noted
that a pumping station for the Clermont city sewer system has been constructed
on the land designated as Carroll Street, in the section requested to be
closed.
E. The names and mailing addresses of property owners abutting the
portion of the street requested to be closed and abandoned are as follows:
