N~ 250 ORDINANCE NO. 76-M AN ORDINANCE UNDER THE CODE OF ORDINANCES OF THE CITY OF CLERMONT, LAKE COUNTY, FLORIDA, ADOPTING THE WATER AND SEWER DEPARTMENT BUDGET FOR THE CITY OF CLERMONT FOR THE FISCAL YEAR 1975-76; AUTHORIZING RECEIPTS AND DISBURSEMENTS CONTAINED THEREIN; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH: PROVIDING FOR SEVERABILITY: PROVID- AN EFFECTIVE DATE; AND PROVIDING FOR PUBLICATION THE CITY COUNCIL OF THE CITY OF CLERMONT, HEREBY ORDAINS THAT; SECTION 1. It is hereby found and determined by the City Council of the City of Clermont, Lake County, Florida, that the following sums of money are required for the water and sewer operations of the government of said City for the fiscal year of October 1, 1975 to September 30, 1976, inclusive. ") Dear Mayor Smoak: Pursuant to your request, I have researched the question of the City's right to restrict the flow of traffic on an open city street. The general law is that a city has the right to vacate or discontinue or portion thereof when done in the interest of the general welfare. LENCHUK, 223 So. 2d. 350 (1969). Florida Statute 167 allows the City any power for municipal purposes, except when expressly prohibited by Rule Act).. any street HURT v to exercise: law (Home There are .several Florida court rulings which indicate the power of cities ex- tends even to the exclusion of traffic from certain streets. However, these cases' and the general law limit the exercise of this power to the benefit of the public interest and welfare. Exclusion of traffic on the subject street would necessarily also apply to ~lr. Wolfe's vehicles. Otherwise you would be restricting traffic not for the public interest, but rather for a private interest.
