AN ORDINANCE UNDER THE CODE OF ORDINANCES OF
THE CITY OF CLERMONT, LAKE COUNTY, FLORIDA,
CLOSING AND PERMANENTLY ABANDONiNG A PORTION OF
OSCEOLA STREET DESCRIBED HEREIN, ACCORDING TO
THE OFFICIAL MAP OF THE CITY OF CLERMONT,
RECORDED IN PLAT BOOK 8, PAGES 17-23, INCLUSIVE,
PUBLIC RECORDS OF LAKE COUNTY, FLORIDA; PROVID-
ING AN EFFECTIVE DATE; AND PROVIDING FOR PUBLICA-
TION.
THE CITY COUNCIL OF THE CITY OF CLERMONT HEREBY ORDAINS THAT:
SECn ON 1.
That portion of Osceola Street located within the City of Clermont, Lake
County, Florida, as hereinafter described, is hereby closed and permanently abandoned:
All that portion of Osceola Street bounded on the
East by the West right of way line of West Lake
Drive and bounded on the West by the East boundary
of Twelfth Street, according to the Official Map
of the City of Clermont, Florida, recorded in Plat
Book 8, pages 17-23 inclusive, Public Records of
Lake County, Florida.
SUBJECT, HOWEVER, to this RESERVATION of a permanent utility easement
and right-of-way over, across, under and through the following described property:

any time it may see fit, to construct, maintain and repair water, drainage, sewer,
electric power and other utility facilities over, across, through and under the land
upon which said easement is reserved, with the right to excavate and refill ditches
and/or trenches for the location of said pipeline and/or ditches, and further reserving
the right to move trees, bushes, undergrowth and other obstructions interfering with
the location, construction and maintenance of said pipelines and/or ditches. The City
of Clermont shall be in no way responsible or liable for damages from whatsoever
cause incidental to the exercise of the right herein reserved unto the City.
SECTION 2.
This closing is done pursuant to the authority of the Charter of the
City of Clermont, Lake County, Florida, and the general 'laws of the State of Floridá.

PETITION
TO: The City Council,
City of Clermont,
Clermont, Florida 32711
The undersigned hereby petitions the City of Clermont to close
and permanently abandon that portion of Osceola Street between West Lake
Drive and Twelfth Street, and in support of this petition offers the
following information in accordance with the prescribed procedure for
street closing:
A. The petitioner's name and mailing address is:

P.O. Box 158,
Clermont, Florida 32711
B. The legal description of the petitionerls property involved is:
Lots 7, 8, 9, 10, II, 12, 13, and 14, in Block 120, Johnson's
Replat, City of Clermont, abutting Osceola Street on the south side, and
the west one-half of Lot 17 and Lot 18, Block 1~9, Johnson's Replat, City of
Clermont, on the north side.
C. A plot plan showing the property involved and the portion of the
street requested to be closed and permanently abandoned is attached to this
petition and made a part hereof.
D. The purpose for which the street is requested to be closed is as
follows: Clermont Builders Supply, Inc. uses property on both sides of
Osceola Street for business purposes, in the course of which it is necessary
to cross this street right-of-way very often, as much as one hundred times
per day, with heavy material-handling machinery not normally used on a public
street, and in view of the fact that Osceola Street between West Lake Drive
and Twelfth Street is not now opened and maintained as a thoroughfare, and
there is no foreseeable need for this sectinn of Osceola Street to be used by
the public as a street, Clermont Builders Supply, Inc. wishes this section to
be closed in order to make better use of their property for business purposes,
and to assure continued efficient use of their property.
