ORDINANCES EMERGENCY ORDINANCE NO. 71M N~ 239 AN EMERGENCY ORDINANCE UNDER THE CODE OF ORDINANCES OF THE CITY OF CLERMONr, LAIŒ COUNTY, FLORIDA, ESTABLISHmG THE CITY OF CLERMJNI' TRAFFIC INFRACTIONS BUREAU, APPOINrING THE MUNICIPAL JUDGE AS THE CHIEF ADMINISTRATIVE AND JUDICIAL OFFICIAL OF THE TRAFFIC INFRACTIONS BUREAU, DESIGNATING THE CLERK OF THE COURI' AS THE TRAFFIC INFRACTIONS BUREAU OFFICER TO RECEIVE PAYMENT OF CIVIL PENALTIES PAID UNTO THE TRAFFIC INFRACTIONS BUREAU; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH: PROVIDING FOR SEVERABILITY; PROVIDING AN EFFECTIVE DATE. THE CITY COUNCIL OF THE CITY OF CLERMJNT, HEREBY ORDAINS THAT: SECTION 1. Pursuant to Chapter 74-377, Florida Statutes, Laws of Florida 1974, there is hereby created in the City of Clermont a Traffic Infractions Bureau, the purpose and function of which is to administer the provisions of Chapter 74-377, Florida Statutes, Laws of Florida 1974, also known as Chapter 316, Florida Statutes. SECTION 2. The Municipal Judge of the City of Clermont is hereby designated under the Provisions of Chapter 74-377, Florida Statutes, Laws of Florida 1974, as the chief administrative ani judicial officer, whose function shall be to admin- ister the City of Cle:mlont Traffic Infractions Bureau and to preside over the Municipal Court or the Administrative Hearing adjudicating traffic infractions. The Municipal Judge, in addition to all other powers provided by law, shall have all powers provided by Chapter 74-377, Florida Statutes, Laws of Florida 1974. SECTION 3. The Clerk of the Municipal Court is hereby designated, pursuant to the Provision of Chapter 74-377, Florida Statutes, Laws of Florida 1974, as the Officer of the Municipal Court to whom shall be paid all civil penalties paid ani collected under the te:mlS of said Act. In addition, it shall be the duty ani responsibility of the Municipal Court Clerk to keep such accounts and records as may be necessary in the administration of said Chapter 74-377, Florida Statutes, Laws of Florida 1974, also known as Chapter 316, Florida Statutes. SECTION 4. All Ordinances or parts of Ordinances in conflict herewith are hereby . . . repealed. . . MISC. ORDINANCES EMERENGENCY ORDINANCE NO. 71-M N~ 240 SECTION 5. Should any section or part of a section be declared invalid by any court of competent jurisdiction, such adjudications shall not apply or affect any other provision of this Ordinance, except to the extent that the entire section or part of the section may be inseparable in meaning and effect from the section to which such holding shall apply. SECTION 6. It is necessary for the irrmediate preservation of propery, health and safety of the City of Clermont, Florida ani its inhabitants that the foregoing Ordinance be inacted with the least possible delay ani this Ordinance is declared to be an emergency measure ani will take effect irrmediately upon its passage ani approvaL PASSED AND ORDAINED BY THE CITY COUNCIL OF THE CITY OF CLERMJNr, LAIŒ COUNTY, FLORIDA, this 28th day of January A.D. 1975.
